STATE OF HAWAI`I <br />-43 <br />RESOLUTION NO. �5 <br />RESOLUTION AUTHORIZING A GRANT OF EASEMENT FOR UTILITY PURPOSES <br />TO HAWAI`I ELECTRIC LIGHT COMPANY, INC., OVER TAX MAP KEY (3) 6-8- <br />041:023 (POR.). <br />WHEREAS, the Hawaii Electric Light Company, Inc., ("HELCO") plans to provide <br />electrical service to the new Keolalani at Waikoloa subdivision in South Kohala, County and <br />State of Hawaii; and <br />WHEREAS, the County of Hawaii ("County") owns the parcel Tax Map Key (3) 6-8- <br />041:023; and <br />WHEREAS, HELCO requested an easement from the County of Hawaii that will allow <br />for the installation of vacuum switch equipment to be stationed there as described in Exhibit <br />"A"; and <br />WHEREAS, Exhibit "B" further identifies E-16, for vacuum switch purposes, across Lot <br />22 of the Kamakoa Nui Workforce Housing Subdivision, covered by TMK. No. (3) 6-8-041:023; <br />and <br />WHEREAS, the Departments of the County of Hawaii have stated no objections to this <br />easement being granted; and <br />WHEREAS, the independent appraisal valued this easement at FIVE HUNDRED <br />NINETY AND 00/100 DOLLARS ($590.00); and <br />WHEREAS, pursuant to Sections 2-111(2) and 2-112, Hawaii County Code, the <br />Council is authorized to grant easements, subject to reverter to the County of Hawaii upon <br />termination or abandonment of the specific purpose without auction upon a finding of substantial <br />purpose; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that the <br />Finance Director is hereby authorized to negotiate a grant of easement to HELCO pursuant to <br />Chapter 2, Article 19, Hawai`i County Code, across parcel Tax Map Key (3) 6-8-041-023 as <br />described in Exhibit "A", and that such grant of easement is subject to reversion to the County of <br />Hawaii upon its termination or abandonment. <br />BE IT FURTHER RESOLVED that the Council of the County of Hawaii finds <br />substantial purpose in granting HELCO this easement without auction given the easement is to <br />enhance and expand necessary electrical service to additional areas. <br />
