Kimball, Council Member C/ x <br />Council District 1 <br />SUBJECT: Proposed Amendment to Bill No. 199; An Ordinance Amending Section <br />25-8-11 (Lalamilo-Pu`ukapu Zone Map), Article 8, Chapter 25 (Zoning <br />Code) of the Hawaii County Code 1983 (2016 Edition, as amended), by <br />Changing the District Classification from Agricultural — 5 acres (A-5a) to <br />Residential Agricultural — 0.5 acres (RA-0.5a) and Neighborhood <br />Commercial — 10,000 square feet (CN-10) at Waimea, South Kohala, <br />Hawaii, covered by Tax Map Key: 6-4-024:027. <br />Attached please find proposed amendments to Bill No. 199. The proposed amendments are <br />illustrated below in Ramseyer format with respect to the contents of Bill No. 199; material to be <br />added is underscored. <br />SECTION 2 of Bill No. 199 is amended to read as follows: <br />"SECTION 2. In accordance with Section 25-2-44, Hawai`i County Code 1983 (2016 <br />Edition, as amended), the County Council finds the following conditions are: <br />(1) Necessary to prevent circumstances which may be adverse to the public <br />health, safety and welfare; or <br />(2) Reasonably conceived to fulfill needs directly emanating from the land use <br />proposed with respect to: <br />(A) Protection of the public from the potentially deleterious effects of <br />Hawai `i Count) is an Equal Opportunity Provider and Employer.
