COUNTY OF HAWAI`I <br />JM.V 0r <br />.1,q�Y <br />STATE OF HAWAI`I <br />,r[ OF•H�'� <br />BILL NO. 12 <br />ORDINANCE NO. 25 22 <br />AN ORDINANCE AMENDING CHAPTER 5D, ARTICLE 1, SECTIONS 5D-1-3 AND <br />5D-1-6, OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION, AS AMENDED), <br />RELATING TO THE ELECTRICAL CODE. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: <br />SECTION 1. Chapter 51), article 1, section 5D-1-3, of the Hawaii County Code 1983 <br />(2016 Edition, as amended), is amended to read as follows: <br />"Section 5D-1-3. Scope; exceptions. <br />This chapter shall apply to electrical work and installations within the County <br />inland of the shoreline high-water line[. This ehapter- shall net apply to ] ex, cept: <br />(1) Work or installations not covered by the National Electrical Code, 2017 <br />Edition, as adopted [ .] in section 5D-2-1; <br />and <br />(2) Electrical work by an electrical utility on any generating plant, receiving <br />station, switching station, distributing station, supply lines or mains, overhead <br />service drop, and underground or station service supply conductor under the <br />control of the utilitv." <br />SECTION 2. Chapter 51), article 1, section 5D-1-6, of the Hawaii County Code 1983 <br />(2016 Edition, as amended), is amended by adding a definition to be appropriately inserted and <br />to read as follows: <br />""Electrical utility" means a: <br />(1) Public utilitv that produces. convevs, transmits. delivers, or furnishes <br />electricity to the public; or <br />(2) Person or entity who provides or intends to provide electricity for sale directly <br />to a public utility, subject to regulation by the Public Utilities Commission. <br />As used herein. "public utilitv" means the same as defined by section 269-1, <br />Hawaii Revised Statutes." <br />SECTION 3. Material to be repealed is bracketed and stricken. New material is <br />underscored. In printing this ordinance, the brackets, bracketed and stricken material, and <br />underscoring need not be included. <br />
