JNZY OF 14 <br />COUNTY OF HAWAIII STATE OF HAWAPI <br />tTF OF NF'� <br />RESOLUTION NO. 142 25 <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAI`I'S <br />DEPARTMENT OF TRANSPORTATION AS WELL AS GRANT A REAL PROPERTY <br />LICENSE OR PERMIT FOR THEIR INSTALLATION AND UPKEEP OF NATIONAL <br />ELECTRIC VEHICLE INFRASTRUCTURE SYSTEMS AT VARIOUS COUNTY OF <br />HAWAI`I PROPERTIES. <br />WHEREAS, Hawaii Revised Statutes Section 46-7 requires the County to obtain <br />consent of the Council to enter into agreements with the federal or state governments respecting <br />action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive <br />any funds or other assistance in connection with projects being or to be undertaken pursuant to <br />those powers; and <br />WHEREAS, Hawaii County Code Section 2-120(a)(4) requires the County to obtain <br />consent of the Council to grant a real property license or permit to governments and <br />governmental agencies; and <br />WHEREAS, the Department of Parks and Recreation, the Department of Public Works, <br />and the Hawaii Police Department desire the ability to enter into an Memorandum of Agreement <br />with the State of Hawai`i's Department of Transportation ("DOT") that allows DOT to install <br />and maintain National. Electric Vehicle Infrastructure ("NEVI") Charging Stations at each of the <br />following sites: Ho`olulu Complex, West Hawaii Civic Center, and the Waimea Civic Center; <br />now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that in <br />accordance with Hawaii Revised Statutes Section 46-7 and Hawaii County Code Section 2- <br />120(a)(4), the Mayor, on behalf of the County of Hawaii, is authorized to execute an <br />
