(3) 6-4-006:050,SITUATED AT PU'UKAPU,DISTRICT OF <br /> SOUTH KOHALA,ISLAND, COUNTY,AND STATE OF HAWAI`I. <br /> WHEREAS, Meril Mulierre Caceres and Lora Taylor De Oliveira(hereinafter"the <br /> Owners") own the real property identified by Tax Map Key No. (3) 6-4-006:050 (hereinafter <br /> "the subject Property"),being Lot 1-A of Land Patent Grant No. 4661 to John Watt and David <br /> Forbes and containing an area of approximately 12,000 square feet, situated at Pu'ukapu, District <br /> of South Kohala, Island, County, and State of Hawai`i, as depicted on Exhibit A, attached hereto <br /> and made a part hereof; <br /> WHEREAS,the Owners wish to donate the subject Property to the County for drainage <br /> maintenance purposes; and <br /> WHEREAS,the Department of Public Works is willing to accept the subject Property in <br /> order to maintain surrounding drainageways and better protect nearby properties, including the <br /> Waimea Police Station and Waimea Fire Station located across the street from the subject <br /> Property; and <br /> WHEREAS, Section 13-12 of the Charter of the County of Hawai`i (hereinafter"the <br /> Charter")provides that the Council"on behalf of the county,may accept gifts of donations of <br /> money, securities or other personal property or of real estate or any interest in real estate"; now, <br /> therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that, <br /> pursuant to Section 13-12 of the Charter,this body hereby accepts the donation of the subject <br /> Property, as hereinabove described and depicted on Exhibit A,by the Owners thereof for <br /> drainage maintenance purposes. <br />
