STATE OF HAWAI'I RESOLUTION NO. 202 25 A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF LATER FISCAL YEARS TO ENTER INTO A MULTI-YEAR LEASE AGREEMENT FOR REAL PROPERTY TO BE USED BY THE DEPARTMENT OF PARKS AND RECREATION. WHEREAS, Section 10-11 of the Charter of the County of Hawai`i (hereinafter"the Charter")provides, in part,that"any contract, lease or other obligation requiring the payment of funds from the appropriations of a later fiscal year or of more than one fiscal year shall be made or approved by resolution"; and WHEREAS,the Department of Parks and Recreation(hereinafter"the Department") wishes to enter into a multi-year lease agreement with Ocean View Community Association, Inc., with a term of two years commencing July 1, 2025 and ending June 30,2027 and an option to extend the lease for one more year; and WHEREAS,the purpose of this agreement is to allow the Department's Elderly Activities Division use of the Ocean View Community Center, located at 92-8924 Leilani Circle, Ocean View, Ka`u, for its Adult Nutrition Services Program, from Monday through Friday, between the hours of 8:00 a.m. and 1:00 p.m.; and WHEREAS,the Department estimates the monthly cost of this lease agreement to be $450; and WHEREAS, approximately 3,200 square feet will be leased under this agreement, which is significantly larger than the 600-square-foot space previously utilized by the Department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that the Mayor is hereby authorized to enter into a multi-year lease agreement with Ocean View Community Association,Inc., for the purposes hereinabove described.
