COUNTY OF HAWAIII •� _• STATE OF HAWAPI <br />f� OF'M►Y+ <br />RESOLUTION NO. 265 25 <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />INTERGOVERNMENTAL AGREEMENT WITH THE UNITED STATES OF <br />AMERICA, FEDERAL AVIATION ADMINISTRATION, FOR A LEASE OF REAL <br />PROPERTY AT THE GILBERT KAHELE RECREATION AREA. <br />WHEREAS, Section 46-7 of the Hawaii Revised Statutes requires the consent of the <br />Council in order for the County to enter into an agreement with the federal government or any <br />other public body respecting action to be taken pursuant to any of the powers granted to the <br />County by law and furnish, expend, and receive any funds or other assistance in connection with <br />projects being or to be undertaken pursuant to those powers; and <br />WHEREAS, Section 2-120(a)(2) of the Hawaii County Code 1983 (2016 Edition, as <br />amended) (hereinafter the "County Code") requires the approval of a resolution by the Council in <br />order to lease real property to governments or governmental agencies; and <br />WHEREAS, the Federal Aviation Administration (hereinafter the "FAA") desires to <br />enter into an agreement with the County for a lease of approximately sixty-four square feet (64 <br />sq. ft.) of real property, located on a portion of the land identified by Tax Map Key No. (3) 4-4- <br />016:003, also known as the "Gilbert Kahele Recreation Area"; and <br />WHEREAS, the purpose of this lease agreement is to allow the FAA to place four (4) <br />aviation weather cameras and one (1) weather instrument on top of an existing water tower and <br />to install a non -penetrating wooden platform, measuring eight feet by eight feet (8 ft. X 8 ft.), and <br />a Unistru& frame, measuring six feet by six feet (6 ft. x 6 ft.), to hold two (2) solar panels, a <br />camera control unit, and associated wiring and electronics to support the cameras and weather <br />instrument; and <br />WHEREAS, the proposed lease agreement does not involve the expenditure or receipt of <br />any funds; now therefore, <br />
