COUNTY OF HAWAIII •� _• STATE OF HAWAPI f� OF'M►Y+ RESOLUTION NO. 265 25 A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE UNITED STATES OF AMERICA, FEDERAL AVIATION ADMINISTRATION, FOR A LEASE OF REAL PROPERTY AT THE GILBERT KAHELE RECREATION AREA. WHEREAS, Section 46-7 of the Hawaii Revised Statutes requires the consent of the Council in order for the County to enter into an agreement with the federal government or any other public body respecting action to be taken pursuant to any of the powers granted to the County by law and furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers; and WHEREAS, Section 2-120(a)(2) of the Hawaii County Code 1983 (2016 Edition, as amended) (hereinafter the "County Code") requires the approval of a resolution by the Council in order to lease real property to governments or governmental agencies; and WHEREAS, the Federal Aviation Administration (hereinafter the "FAA") desires to enter into an agreement with the County for a lease of approximately sixty-four square feet (64 sq. ft.) of real property, located on a portion of the land identified by Tax Map Key No. (3) 4-4- 016:003, also known as the "Gilbert Kahele Recreation Area"; and WHEREAS, the purpose of this lease agreement is to allow the FAA to place four (4) aviation weather cameras and one (1) weather instrument on top of an existing water tower and to install a non -penetrating wooden platform, measuring eight feet by eight feet (8 ft. X 8 ft.), and a Unistru& frame, measuring six feet by six feet (6 ft. x 6 ft.), to hold two (2) solar panels, a camera control unit, and associated wiring and electronics to support the cameras and weather instrument; and WHEREAS, the proposed lease agreement does not involve the expenditure or receipt of any funds; now therefore,
