COUNTY OF HAWAI`I <br />ORDINANCE NO. <br />STATE OF HAWAI`I <br />BILL NO. 75 <br />AN ORDINANCE REPEALING SECTION 5 OF ORDINANCE NO.22-94 AND <br />AMENDING CHAPTER 18, ARTICLE 4, DIVISION 1, SECTION 18-90, OF THE <br />HAWAI`I COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO <br />FARES FOR PUBLIC TRANSPORTATION. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: <br />SECTION 1. Findings and purpose. The Council finds that the temporary suspension of <br />fares for all riders using any mass transit service owned, maintained, or operated by the County, <br />excluding County -contracted shared -ride services and County -operated curb -to -curb van services <br />operated by the Department of Parks and Recreation, will expire on December 31, 2025. This <br />ordinance extends the temporary fare suspension for three more years, until December 31, 2028. <br />The County Mass Transit Agency received grant funds from the State of Hawaii, through its <br />Department of Transportation, as a subrecipient to the United States Department of <br />Transportation, through its Federal Transit Administration. The grant funds received will be <br />used by the Mass Transit Agency to cover operational costs for the duration of the fare <br />suspension. This ordinance is intended to remove barriers to riding public transit, to provide <br />sufficient time to implement a micro -transit program, and to continue to build upon ridership. <br />SECTION 2. Chapter 18, article 4, division 1, section 18-90, of the Hawaii County <br />Code 1983 (2016 Edition, as amended) is amended by amending subsection (h) to read as <br />follows: <br />"(h) Suspension of fares; non -applicability to some services; terminates December 31, <br />[242-5] 2028. <br />(1) All fares established by this section shall be suspended through December 31, <br />[2425] 2028. Riders boarding and alighting any mass transit service owned, <br />maintained, or operated by the County, shall ride free of charge. <br />(2) This subsection shall not apply to County -contracted shared -ride services and <br />County -operated curb -to -curb van services operated by the department of <br />parks and recreation. <br />(3) The suspension of fares shall automatically terminate on December 31, <br />[202-S,-] 2028, unless extended by the council. <br />(4) Each year, no later than July 30 after the close of the fiscal year, the mass <br />transit administrator shall provide a report to the council regarding the <br />performance of the mass transit system, including passenger trips carried by <br />route, comparison to the prior year and any other service performance data <br />requested by the council to evaluate the suspension of fares prescribed by this <br />subsection." <br />
