COUNTY OF HAWAPI <br />RESOLUTION NO. <br />STATE OF HAWAPI <br />288 25 <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAI`I, THE <br />COUNTY OF KAUA`I, THE COUNTY OF MAUI, AND THE CITY AND COUNTY OF <br />HONOLULU FOR THE PURPOSE OF ADMINISTERING CERTAIN PROVISIONS OF <br />ACT 96, SESSION LAWS OF HAWAI`I 2025. <br />WHEREAS, Section 46-7 of the Hawaii Revised Statutes requires the consent of the <br />Council in order for the County to enter into an agreement with the federal government or any <br />other public body respecting action to be taken pursuant to any of the powers granted to the <br />County by law and furnish, expend, and receive any funds or other assistance in connection with <br />projects being or to be undertaken pursuant to those powers; and <br />WHEREAS, Act 96, signed into law by the Governor on May 27, 2025, makes gross <br />rental proceeds from cruise ship fares subject to the transient accommodation tax (TAT), <br />prorated by the percentage of days docked in any port in the State to the total number of days of <br />the voyage; and <br />WHEREAS, the relevant fiscal agencies and departments of the State and various <br />counties have agreed on a method of allocation of the TAT in cases where a cruise ship docks in <br />two or more counties during a single day; and <br />WHEREAS, the purpose of this agreement is to facilitate the orderly and uniform <br />administration of the TAT on cruise ships across the State; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that, <br />pursuant to Section 46-7 of the Hawaii Revised Statutes, the Mayor is hereby authorized to enter <br />into an agreement with the State of Hawaii, the County of Kauai, the County of Maui, and the <br />City and County of Honolulu for the purposes hereinabove described. <br />
