REPORT OF THE <br />COMMITTEE ON FINANCE <br />DATE: August 19, 2025 <br />PLACE: Council Chambers <br />Kailua-Kona, Hawaii <br />TIME: 10:00 a.m. <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Re: Comm. No. 428/Res. No. 266-25 <br />Your Committee on Finance, to which was referred Resolution No. 266-25, reports as follows: <br />Resolution No. 266-25, transmitted by Deputy Corporation Counsel Mark D. Disher via <br />Communication No. 428, dated July 31, 2025, authorizes indemnification of a former employee of the <br />County who is named as an individual defendant in the lawsuit known as David J. Freedman v. County <br />of Hawaii, et. al. against all damages assessed therein and making other findings in accordance with <br />Section 2-188 of the Hawaii County Code. <br />This resolution provides indemnification for Douglass S. Adams, former Director of the Department of <br />Research and Development, regarding a civil action alleging claims against the County and Mr. Adams <br />for employment discrimination, emotional distress, and negligent supervision. <br />Deputy Corporation Counsel Mark Disher was present for questions. <br />Committee Member Dennis "Fresh" Onishi stated that any discussion on this matter would need to be <br />done in Executive Session. Committee Member Rebecca Villegas agreed but pointed out that much of <br />the information was already a matter of public record, and asked if the committee was voting on whether <br />the County should represent Mr. Adams.
