MEMORANDUM OF UNDERSTANDING <br />BETWEEN <br />U.S. DEPARTMENT OF VETERANS AFFAIRS <br />PACIFIC ISLAND HEALTH CARE SYSTEM (VAPIHCS) <br />AND <br />HAWAI'I COUNTY POLICE DEPARTMENT (HPD) <br />This Memorandum of Understanding (MOU) is entered into between the U.S. Department <br />of Veterans Affairs Pacific Islands Health Care System (VAPIHCS) and the Hawai'i <br />County Police Department (HPD), hereinafter referred to as the "Parties". <br />1. PURPOSE. <br />To establish general working relationships between the VAPIHCS VA Police Service and <br />HPD as a means of reinforcing interagency coordination and responsibility concerning <br />law enforcement, emergency response, mutual aid, physical security, requests for <br />assistance, physical security and access control operations for VAPIHCS, Hilo VA <br />Community Based Outpatient Clinic (CBOC), located at 45 Mohouli Street, Hilo, HI 96720 <br />and the Kailua-Kona VA CBOC, located at 73-5618 Maiau Street, Kamanu Center, Suite <br />C200, Kailua-Kona, HI 96740. <br />2. REFERENCES. <br />a. VA Directive 0730, Security and Law Enforcement, dated December 12, 2012 <br />b. VA Handbook 0730, Security and Law Enforcement, dated August 11, 2000 <br />3. GENERAL. <br />a. VAPIHCS, also known as VA Pacific Islands Health Care System, has facilities <br />located in the City of Hilo and Kailua-Kona. VAPIHCS provides Primary, Specialty, <br />and Extended Care services to Veterans throughout the Hawaiian Islands, Guam, <br />Saipan, and American Samoa. The mission of the VAPIHCS is to provide timely, <br />efficient, ethical, safe, compassionate, and quality health care to Veteran patients. <br />b. All properties under the control or ownership of the Department of Veterans Affairs <br />(such as the CBOCs noted), except for the VA controlled properties on the Tripler <br />Medical Center Campus are Proprietorial jurisdiction. In proprietorial jurisdiction, <br />VA Police Officers are authorized to arrest solely for Federal Offenses and <br />Violations of VA Rules & Regulations. The term "Proprietorial" is applied in those <br />instances wherein the Federal Government has acquired some right or title to an <br />area in a state but has not obtained any measure of the state's authority over the <br />area. Therefore, the State of Hawaii has sole criminal jurisdiction except for <br />violations of federal laws and VA Regulations and rules. <br />c. COMPACT ACT Section 205 Police Crisis Intervention Training for VA Police <br />requires that each VA Medical Center Police Service develop a plan to enter into <br />partnerships with local mental health organizations and experts; Veteran <br />Exhibit "A" <br />
