COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAII <br />39G 25 <br />A RESOLUTION ACCEPTING A DONATION OF PROFESSIONAL SERVICES TO <br />THE DEPARTMENT OF PARKS AND RECREATION FOR RESURFACING WORK <br />AT LINCOLN PARK TENNIS COURTS. <br />WHEREAS, Article XIII, Section 13-12, of the Charter of the County of Hawaii <br />(hereinafter "the Charter") provides that the Council, "on behalf of the county, may accept gifts <br />of donations of money, securities or other personal property or of real estate or any interest in <br />real estate"; and <br />WHEREAS, Chapter 2, Article 30, Section 2-162(a), of the Hawaii County Code 1983 <br />(2016 Edition, as amended) (hereinafter "the Code") provides, in part, that "gifts or donations of <br />money, securities, or personal property which fall within the capitalization procedures of the <br />department of finance may be accepted by resolution approved by the council"; and <br />WHEREAS, United States Tennis Association (hereinafter "USTA"), a not -for -profit <br />entity, donated professional services, including time and work, with an in -kind value of $145,463 <br />for the resurfacing of the tennis courts at Lincoln Park; and <br />WHEREAS, this generous donation benefits the community through the improvement of <br />the County's recreational facilities, thereby encouraging physical activity and promoting public <br />health and welfare; and <br />WHEREAS, the Department of Parks and Recreation is grateful for this donation and <br />recommends its acceptance by the Council; now, therefore, <br />
