The County's Legal Mandate: Fiscal Agent <br />Per 20 CFR § 679.420, the Mayor (the Chief Elected Official) designates a Fiscal Agent (currently the <br />County's Department of Research and Development). <br />• Role: Receive funds, maintain accounting records, respond to audits, and ensure sustained fiscal <br />integrity. <br />• Accountability: The Mayor and the County are ultimately liable for any misspent funds <br />(disallowed costs), even if a contractor spent them. This is why the County must remain an <br />objective monitor rather than a service provider. <br />2. The Workforce Development Board (WDB) Role <br />The Hawaii County WDB is the policy -making body led by private -sector business owners. <br />• Role: Develop the Local Plan, select service providers, and oversee the American Job Center <br />(AJC). <br />3. The Service Provider. The Direct Labor <br />Per WIOA Sec. 107(g)(1) and 20 CFR § 679.430, the Board must competitively procure an outside entity <br />to deliver services. This creates a Firewall. <br />The Law: 20 CFR § 679.430 explicitly states that organizations performing multiple functions (like the <br />County) must have written agreements and internal controls to prevent conflicts of interest.
