Lam^•' <br />COUNTY OF HAWAPI STATE OF HAWAPI <br />•�l y � e o'� <br />Icl <br />RESOLUTION NO. �69 "I <br />A RESOLUTION AUTHORIZING AND DIRECTING THE DIRECTOR OF PUBLIC <br />WORKS TO ISSUE A LICENSE FOR ENTRY, LANDSCAPING, AND MAINTENANCE <br />OF A PORTION OF A RIGHT-OF-WAY OWNED BY THE COUNTY. <br />WHEREAS, Section 2-119(b) of the Hawaii County Code 1983 (2016 Edition, as <br />amended) (hereinafter the "Code") provides that the Council "may, after consulting with the <br />chief of police, direct the director of public works to issue licenses and permits through <br />negotiation and without public auction to enter and occupy public highways and other rights -of - <br />way owned, maintained and/or under the jurisdiction of the County, subject, however, to such <br />restrictions, conditions and terms which will best serve the interests of the County and the <br />general public"; and <br />WHEREAS, the Department of Public Works wishes to grant Kuakini Makai <br />Association, Inc., a Hawaii nonprofit homeowners' association, a revocable license to enter <br />upon, landscape, and maintain a portion of a right-of-way owned by the County, as depicted on <br />Exhibit A, attached hereto and incorporated herein by reference; and <br />WHEREAS, the portion of the County right-of-way in question, identified by Tax Map <br />Key No. (3) 7-6-024:999, situated in the District of Kona, is located on the southern side of <br />Kuakini Highway, to the east of Keakealani Drive, and measures approximately 218 feet long by <br />18 feet wide; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I that, <br />pursuant to Section 2-119(b) of the Code, the Director of Public Works is hereby authorized and <br />directed to issue a license for the purposes hereinabove described, subject to such restrictions, <br />conditions and terms which will best serve the interests of the County and the general public. <br />
