COUNTY OF HAWAII RESOLUTION NO. STATE OF HAWAI`I 4'74 26 A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAI°I, HILO BENIOFF MEDICAL CENTER, TO AUTHORIZE PRIVATE OFF-STREET PARKING AT GILBERT CARVALHO PARK. WHEREAS, Section 46-7 of the Hawaii Revised Statutes requires the consent of the Council in order for the County to enter into an agreement with the federal government or any other public body respecting action to be taken pursuant to any of the powers granted to the County by law and furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers; and WHEREAS, the State of Hawaii, Hilo Benioff Medical Center, (hereinafter "HBMC") desires to enter into an agreement with the County of Hawaii, Department of Parks and Recreation, (hereinafter the "County") to use a portion of the land identified by Tax Map Key No. (3) 2-3-026:005, situated at Pi`ihonua, District of South Hilo, also known as Gilbert Carvalho Park (hereinafter the "Property") for parking purposes; and WHEREAS, the County retains control and management authority over the Property under Executive Order No. 3774; and WHEREAS, HBMC is undertaking multiple large-scale construction projects for the improvement and expansion of medical and associated facilities located approximately one mile from the Property; and WHEREAS, the ongoing construction has negatively affected the availability of parking for HBMC's employees, agents, officers, contractors, representatives, and volunteers; and WHEREAS, as a result, HBMC wishes to use a portion of the Property to be designated by the County as parking space for its employees, agents, officers, contractors, representatives, and volunteers for a period of time not to exceed December 31, 2026; and WHEREAS, this proposed agreement does not involve the expenditure or receipt of any funds; now, therefore,
