COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAI`I <br />4'74 26 <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAI°I, HILO <br />BENIOFF MEDICAL CENTER, TO AUTHORIZE PRIVATE OFF-STREET PARKING <br />AT GILBERT CARVALHO PARK. <br />WHEREAS, Section 46-7 of the Hawaii Revised Statutes requires the consent of the <br />Council in order for the County to enter into an agreement with the federal government or any <br />other public body respecting action to be taken pursuant to any of the powers granted to the <br />County by law and furnish, expend, and receive any funds or other assistance in connection with <br />projects being or to be undertaken pursuant to those powers; and <br />WHEREAS, the State of Hawaii, Hilo Benioff Medical Center, (hereinafter "HBMC") <br />desires to enter into an agreement with the County of Hawaii, Department of Parks and <br />Recreation, (hereinafter the "County") to use a portion of the land identified by Tax Map Key <br />No. (3) 2-3-026:005, situated at Pi`ihonua, District of South Hilo, also known as Gilbert <br />Carvalho Park (hereinafter the "Property") for parking purposes; and <br />WHEREAS, the County retains control and management authority over the Property <br />under Executive Order No. 3774; and <br />WHEREAS, HBMC is undertaking multiple large-scale construction projects for the <br />improvement and expansion of medical and associated facilities located approximately one mile <br />from the Property; and <br />WHEREAS, the ongoing construction has negatively affected the availability of parking <br />for HBMC's employees, agents, officers, contractors, representatives, and volunteers; and <br />WHEREAS, as a result, HBMC wishes to use a portion of the Property to be designated <br />by the County as parking space for its employees, agents, officers, contractors, representatives, <br />and volunteers for a period of time not to exceed December 31, 2026; and <br />WHEREAS, this proposed agreement does not involve the expenditure or receipt of any <br />funds; now, therefore, <br />
