+tV ` <br />COUNTY OF HAWAI`I STATE OF HAWAII <br />RESOLUTION NO. 459 26 <br />(DRAFT 2) <br />A RESOLUTION AUTHORIZING THE PLANNING DEPARTMENT TO AWARD <br />FUNDS FOR THE KILAUEA RECOVERY GRANT PROGRAM. <br />WHEREAS, Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawaii County Code <br />1983 (2016 Edition, as amended) (hereinafter "the Code") provides that grants awarded "in <br />excess of $25,000 to nonprofit organizations shall specifically identify the organization receiving <br />the grant funds and the purpose for which the grant funds shall be used in a resolution"; and <br />WHEREAS, Chapter 2, Article 25, Section 2-136 of the Code defines "nonprofit <br />organization" as "an organization that is registered and in good standing in the State of Hawaii <br />as a nonprofit organization and maintains a 501(c)(3) charitable designation from the Internal <br />Revenue Service'; and <br />WHEREAS, the organizations specified in "Exhibit A", attached hereto and incorporated <br />herein by reference, which correspondingly qualify as nonprofit organizations as defined above, will <br />provide relief, recovery, mitigation, and long-term resilience for disaster damages, losses, and <br />suffering caused by the 2018 K-ilauea eruption; and <br />WHEREAS, the Planning Department wishes to provide a total of $5,977,773.00 to <br />these organizations as outlined in "Exhibit A"; now, therefore, <br />
