COUNTY OF HAWAI`I <br />,ASS nr y� <br />STATE OF HAWAI`I <br />sof H� <br />RESOLUTION NO. <br />460 26 <br />(DRAFT 2) <br />A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF LATER FISCAL <br />YEARS TO ENTER INTO A MULTI -YEAR LEASE AGREEMENT FOR REAL <br />PROPERTY TO BE USED BY THE OFFICE OF THE CORPORATION COUNSEL. <br />WHEREAS, Section 10-11 of the Charter of the County of Hawaii (hereinafter "the <br />Charter") provides, in part, that "any contract, lease or other obligation requiring the payment of <br />funds from the appropriations of a later fiscal year or of more than one fiscal year shall be made <br />or approved by resolution"; and <br />WHEREAS, the Office of the Corporation Counsel (hereinafter "the Lessee") wishes to <br />enter into a multi -year lease agreement with Joy A. San Buenaventura, Trustee of the Joy A. San <br />Buenaventura Revocable Living Trust dated November 26, 2025 (hereinafter "the Landlord % <br />with a term of three years commencing on or about April 1, 2026, and not to exceed December <br />31, 2029, with two options to extend the lease for an additional three years at a rate to be <br />negotiated at that time; and <br />WHEREAS, the Lessee estimates the monthly cost of this agreement to be $2,600.00, <br />plus an additional charge to pay the Hawaii general excise tax, which is currently 4.4386%; and <br />WHEREAS, services covered in the negotiated lease shall include, but are not limited to <br />electricity, water, trash removal for common areas, and dumpsters for tenant use; and <br />WHEREAS, having additional office space is necessary for added personnel filling open <br />position vacancies within the Office of the Corporation Counsel; and <br />WHEREAS, the two units to be leased under this proposed agreement are identified as <br />Apartment Nos. 311 and 312, each containing approximately six hundred square feet of office <br />space and located at 101 Aupuni Street, Hilo, Hawaii 96720; now, therefore, <br />
