-4 0!. <br />COUNTY OF HAWAVI STATE OF HAWAVI <br />RESOLUTION NO. 4, 1 <br />A RESOLUTION AUTHORIZING AND DIRECTING THE DIRECTOR OF FINANCE <br />TO EXCHANGE REAL PROPERTY IDENTIFIED AS PORTIONS OF TAX MAP KEY <br />NO. (3) 2-8-010:999, SITUATED AT HONOMV, SOUTH HILO, FOR PUBLIC <br />ROADWAY AND PUBLIC ACCESS PURPOSES. <br />WHEREAS, Section 2-111 of the Hawaii County Code 1983 (2016 Edition, as <br />amended) (hereinafter, the "Code") allows the Council to direct the Director of Finance to <br />"exchange real property for private property"; and <br />WHEREAS, Section 2-115 of the Code provides, in part, that "[n]o exchange of real <br />property for private property shall be made except for public purposes, including... <br />[s]traightening of boundaries of real property" and "[s]traightening roadways or acquisition of <br />encroachment right-of-way"; and <br />WHEREAS, the County owns the property identified as certain portions of Tax Map <br />Key No. (3) 2-8-010:999, containing approximately 4.571 acres of real property, situated in <br />Honormi, South Hilo (hereinafter, "the County's Property"); and <br />WHEREAS, the County's Property is depicted and labeled as "County of Hawaii to <br />Stella Larsen" on Exhibit A and is more particularly described in Exhibit C, both of which are <br />attached hereto and incorporated herein by reference; and <br />WHEREAS, Stella May Larsen, Trustee of the Stella May Swain Trust (hereinafter, <br />"Larsen") owns the property identified as certain other portions of Tax Map Key No. 2-8- <br />010:999, containing 6.203 acres of real property and a 4.578-acre public access easement, <br />situated in Honorn-Ci, South Hilo (hereinafter, the "Larsen Property"); and <br />WHEREAS, the Larsen Property is labeled in Exhibit A as "Stella Larsen to County of <br />Hawaii" and more particularly described in and attached hereto as Exhibit 13, a copy of which is <br />attached hereto and incorporated herein by reference; and <br />WHEREAS, to align and straighten Wailele Road and ensure public access to the Hilo <br />Forest Reserve, the County seeks to acquire the Larsen Property in exchange for the County's <br />Property; and <br />WHEREAS, Larsen has agreed to exchange the Larsen Property for the County's <br />Property; and <br />WHEREAS, the County complied with the public notice requirements set forth in <br />Section 2-116(d) of the Code by publishing notice of the exchange in the Hawai'i Tribune - <br />Herald for three successive weeks in December 2025; now, therefore, <br />
