COUNTY OF HAWAY1 STATE OF HAWAPI RESOLUTION NO. 0-f� RESOLUTION ACCEPTING THE GRANT OF EASEMENTS FROM CONTINENTAL PACIFIC, LLC FOR PUBLIC ACCESS PURPOSES. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I. WHEREAS, CONTINENTAL PACIFIC, LLC is the owner and/or has reserved the right to grant specific easement Tights affecting Tax Map Keys: (3) 2-8-008:003, 041, 100, 129, 135, and 149 to 158 inclusive, situated in Kapehu, Kaupakuea, Kahua and Makahanaloa, District of South Hilo, County and State of Hawaii; WHEREAS, the County of Hawaii would like to acquire pedestrian public access to and along the shoreline and sea cliffs in the Pepeekeo Point area; WHEREAS, CONTINENTAL PACIFIC, LLC is desirous of granting the County of Hawaii easements, which easements are more particularly described and delineated in Exhibit "I" attached hereto as a Grant of Public Access Easements; WHEREAS, CONTINENTAL PACIFIC, LLC has previously recorded a Declaration of Vehicular and Parking Public Access Easements with the Bureau of Conveyances that provide vehicular public access between Hawaii Belt Road and the pedestrian public access easements described in Exhibit "I", and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council, on behalf of the County of Hawai'i, may accept gifts or donations of money, securities or other personal property or of real estate or any interest in real estate. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAIII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the County of Hawaii accepts the grant of Easements described and delineated in Exhibit "l" attached hereto, from CONTINENTAL PACIFIC, LLC.
