COUNTY OF HAWAI`I •_ STATE OF HAWAI`I <br />RESOLUTION NO.4S <br />A RESOLUTION AMENDING RULE NO. 2 OF THE RULES OF PROCEDURE AND <br />ORGANIZATION OF THE COUNCIL OF THE COUNTY OF HAWAI`I, RELATING <br />TO EXCUSED AND UNEXCUSED ABSENCES. <br />WHEREAS, on December 2, 2024, the Council of the County of Hawaii (hereinafter, <br />the "Council") adopted the Rules of Procedure and Organization of the Council of the County of <br />Hawai `i (hereinafter, the "Rules") as provided in Resolution No. 3-25 to govern the affairs of the <br />Council; and <br />WHEREAS, Rule No. 16-1 provides, in part, that the Rules "may be amended at a <br />regular Council meeting by a resolution approved by an affirmative majority vote of the entire <br />membership of the Council"; and <br />WHEREAS, the Council finds that Rule No. 2 bears further consideration and <br />clarification; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAPI that <br />Rule No. 2 of the Rules is hereby amended by substituting subrule 9 with the following: <br />"9. Excused and Unexcused Absences. <br />(a) A Council Member who is unable to attend a Council meeting shall <br />T provide written notice to the Council Chairperson as soon as practicable, <br />stating the reason for the absence. <br />(b) The Council Chairperson shall determine whether an absence is excused <br />or unexcused based on the information provided and any additional <br />relevant circumstances. In making such determination, the Chairperson <br />may consider, among other factors: <br />1. Illness medical treatment, or any health -related condition of the <br />member or an immediate family member; <br />2. Official County business or governmental service requiring the <br />member's attendance elsewhere; <br />3. Family emergency, bereavement, or significant personal obligation-, <br />or <br />4. Unavoidable travel disruption or other circumstance beyond the <br />reasonable control of the member. <br />(c) The determination of the Council Chairperson shall be announced for the <br />record and entered into the minutes of the meeting. <br />(d) A determination of an absence may be appealed to the Council by <br />communication submitted to the Council Chairperson, which shall be placed <br />on the next available Council agenda. Approval of the appeal shall require the <br />affirmative vote of a majority of the entire membership of the Council. <br />
