I Should the Council adopt a Unified Impact Fees Ordinance setting forth cntena <br /> for ~mposthon of exacUOns or the assessment of impact fees, conditions included <br /> herein shall be credited towazds the requirements of the Unified Impact Fees <br /> Ordinance <br /> J Comply with all applicable laws, rules, regulations and requtrements of affected <br /> agencies for approval of the proposed development w~thtn the subJect property <br /> <br /> K An in~rial extension of time for the performance of conditions within the <br /> ordinance may be granted by the Planning Director upon the following <br /> circumstances <br /> 1 The non-performance is the result of condirions that could not have been <br /> foreseen or aze beyond the control of the applicants, successors or assigns, <br /> and that aze not the result of their fault or negligence <br /> 2 Granting of the hme extension would not be contrary to the General Plan <br /> or Zoning Code <br /> 3 Grantrng of the rime extension would not be contrary to the onginal <br /> reasons for the grantrng of the change of zone. <br /> 4 The ume extension granted shall be for a penod not to exceed the penod <br /> ong~nally granted for performance e , a condition to be performed <br /> within one yeaz may be extended for up to one additional yeaz) <br /> 5 If the applicant should require an additional extension of time, the <br /> -4- <br /> <br />
