(11 <br /> (Draft 2) <br /> RESOLliTION ACCEPTING THE DEDICATION OF THE IMPROVEMENTS AND THAT <br /> CERTAIN ROADWAY PARCEL BEING A PORTION OF HIENALOLI-KAHULUI ROAD, <br /> SITLATE INN KONA, ISLAND AND COLnITY OF HA~'~'AI`I, STATE OF HAVb'AI`I, <br /> FROM MARYL GROUP, INC , BEING A PORTION OF TAX MAP KEY (3)7-5-011 002, TO <br /> THE COUNTY OF HAWAII <br /> WHEREAS, Maryl Group, Inc , a Hawai i corporation, ~s the owner of that certain <br /> roadway parcel being a pomon of Htenalolo-Kahulw Road, located m N Kona, Hawat`t, <br /> specifically identified as a portion of Tar Map Key (3)7-5-O1 1 002, being more particularly <br /> descnbed in the attached dedication deed (Exhibit "A") and delineated on Exhibn "B" attached <br /> hereto, and <br /> V1•'I-IEREAS, Maryl Group, Inc has constructed roadway and drainage improvements and <br /> has received final subdivision approval, and <br /> WHEREAS, MaryI Group, Inc is desirous of dedicating the subject parcel, including all <br /> subdivision improvements thereon, to the County of Haw•ai`i for road and drainage purposes, and <br /> the improvements have been inspected and approved by the County of Hawaii Department of <br /> Public Works, Department of Water Supply and the Planning Department, and <br /> W7IEREAS, the subject road and drainage improvements have been completed according <br /> <br /> to County of Hawaii standards, are m acceptable condition for dedication, and <br /> WHEREAS, the roadway lot was platted pnor to December 2, 1966, and is a portion of <br /> <br /> the Hienaloli-Kahului Road, which is open to and used by the public on a continuous basis, and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the <br /> <br /> Council may accept gifts which include the dedtcatton of land on behalf of the County of <br /> Hawaii, <br /> <br />
