They revolve around the Hawaii <br /> <br /> County Planning Commission meeting of December 17, 1999, which you had prevwusly <br /> referenced in your letter ofNovember 1, 1999(HWY-H 99.2.1007). I have been advised <br /> that yow staff neither provided comment nor attended this meeting. Please provide an <br /> explanation for your lack of participation, given vour previous reference to thic m~srinc <br /> While your department provided no comment the applicant has submitted a letter from <br /> you in support of their application. I have been provided a copy of this letter of March <br /> IS, 1999 (HWY-H 99-201%) to Mr. Robert Saunders of W.H.Shipman in which you <br /> offer your "full support" for their development plans and advise him that you wilt <br /> "e:ped~te our rwiaw and approval of your plans". When you told me on August 17ih <br /> t11at "any request for access will be scrutinized thoroughly" what exactly did you mean <br /> The contradictions here are explicit and requite immediate clarification. <br /> of the iilsues raised by the public at this hearing in opposition to the change to a 4-way <br /> it#ersecdion the one that rosy be the most significant is the releasing of the Controlled <br /> Access designation for new commercial purposes. My understanding of HRS 264-64, <br /> vJ}iieh covers the design ofcontrolled-access facilities, obligates the Director to "regulate, <br /> restrict, or prohibit access to best save the traffic for which sucfi facility is intended." <br /> The Kesau Bypass Road wee funded so the commuters of lower Puna could avoid the <br /> emngestibn of the existing Keeau intersection. ltnmediate commercial development was <br /> nQt the intent of the facility. Plesae provide an explanation for the release of this <br /> d~signadon <br /> I tuggest you obtain a transcript of the above meeting aad determine whether your staff <br /> sbould provide accurate answers to the questions raised by the public.
