The current tax rate for vacant (unimproved) land is $10.00 per $1,000 of assessed valuation.
The current assessed value of lots in Kalapana Gardens in $100.
With the proposed minimum tax of $100 The tax levy on Kalapana Gardens lots would be
$1,000 per $1,000. That's one hundred times greater than the currently established tax rate. That
would be gross discrimination.
I respectfully request that land recently covered by lava be removed from the tax roles until
infrustructure is restored to provide access and water service. This will save the county tax
department the incremental cost of servicing these properties.
Actually the discriminatory taxes collected since 1992 should be refunded.
There is no evidence that adding one tax lot to the current tax roles would increase the operating
costs of the tax department by anything near $100. The Council should initiate a study to
determine the actual incremental cost of adding a single tax lot to the tax roles.
The minimum tax should (at the most) be based on the incremental cost of adding a tax lot to the
tax roles.

We purchased our "little bit of heaven" in 1968 when my husband and I were on
our honeymoon. We have had nothing but miscommunication and the reminder
that this truly was a bad investment since! The current tax rate for vacant
unimproved land is
10.00 per $1,000 of assessed valuation.
The current assessed value of lots in Kalapana Gardens is $100.00
With the proposed minimum tax of $100.00, the tax levy on Kapana Gardens lots
would be $1,000 per $1,000! That's one hundred times greater than the
currently established tax rate! That would be gross discrimination. I feel
that we have been discriminated against already by the FIMA problems!!!!!

I understand that [the Island of] Hawaii is chronically short of tax base and may be tempted
to "scrape the bottom of the barrel°' via a minimum tax on lava-covered land -particularly
since that would probably affect absentee owners more than locals. However, one wonders
if there are any reasons for the proposed increase except to shift the social burden of the
dig Island to others.

We own lots in Kalapana Gardens which we are paying taxes on. How can the county increase
taxes when they haven't restored the roads and water to that area with the money that was
allotted to them from FEMA for that purpose?
We believe a moratorium should be placed on all taxes in that area until the water and roads are
restored to Kalapana Gardens. FEMA should have demanded that the money allotted to the
county for the Kalapana Gardens restoration project should have been spent in the area it was
meant for. IVow the county wants more money from the landowners? Get real, who's running the
show? Let the county go to FEMA, maybe they'll give it to them. Sounds like the county controls
what Fema does with their money anyway.

Councilman Safarik,
I am a property owner in Kalapana Gardens, and recommend in the very
strongest terms that a moratorium on taxes be imposed until infrastructure
improvements are made. It is appalling that the monies granted by FEMA to
restore roads and water to Kalapana Gardens was used by the county for an
alternate project.
Our property was originally purchased by my mother, Dorothy Johnson, now
deceased.

Dear Representative Gary Safarik,
I am 65 years old, and am an owner of a 7500 sq ft lot in Kalapana gardens.
I vehemently protest any taxes on a property tabled as Danger Keep out by Harry Kim X helpers of even
$25/year, and am shocked and appalled at a tax of $100 per year on a property assesed as valued a total of
$100 total a 100% of the value of the lot in one year.
I have been paying from 1987 a total of $350 in taxes for a lot that I am forbidden from using by the authorities
with a sign plainly posted in Kalapana Gardens subdevision 350% times the lot value has been extorted from
me by the county for a lot I hope in my lifetime to become usable.
The county considers it unsafe to rebuild the roads and to reinstal the watter lines we had in kalapana gardens,
yet it exacts a tax.
Please STOP THE TAX INCREASE and propose a bill to place a moratorium on Taxes on kalapana gardens
till it is safe to use the property and till the county also rebuilds the county roads and watterlines that would
make the property accesible to a serveyor. I have no clue where my lot is located. and the surveyor is forbiden
from enering the subdivision.

We own two lots located at the once-beautiful Kalapana Gardens. Since the funds approved by
FEMA for rebuilding in that area have not yet been put to use there, the property is basically
useless. Living there or selling are not options as it remains wasteland.
It is my strong recommendation that areas such as this not have a $100 tax minimum...the land
isnt even worth that much. Seems to me that some type of moratorium on that tax would work
until the necessary improvements become a reality.

Subject: The bill to increase the minimum real estate taxes to $100 proposed by Councilman
Curtis Tyler.
Dear Council Person:
The current tax rate for vacant (unimproved) land is $10.00 per $1,000 of assessed valuation.
The current assessed value of lots in Kalapana Gardens in $100.
With the proposed minimum tax of $100 The tax levy on Kalapana Gardens lots would be
$1,000 per $1,000. That's one hundred times greater than the currently established tax rate. That
would be gross discrimination.
I respectfully request that land recently covered by lava be removed from the tax roles until
infrustructure is restored to provide access and water service. This will save the county tax
department the incremental cost of servicing these properties.
Actually the discriminatory taxes collected since 1992 should be refunded.
There is no evidence that adding one tax lot to the current tax roles would increase the operating
costs of the tax department by anything near $100. The Council should initiate a study to
determine the actual incremental cost of adding a single tax lot to the tax roles.
The minimum tax should (at the most) be based on the incremental cost of adding a tax lot to the
tax roles.
I respectfully request that the Hawaii County Council kill the bill to increase in minimum real
estate taxes to $100 proposed by Councilman Curtis Tyler.

My mother-in-law pays taxes at Kalapana Gardens. Please support a moratorium on any new

Dear Sir, It doesn't seem fair to charge taxes on
property that has not access and therefore is not habitable. I have tried to sell this property to no
avail, even the Salvation Army, and Francis Parker school were not accept the property as a
charitable contribution.
Femma has admitted that their funded money to replace the roads etc. were used for other
purposes. Is that legal? If so, it certainly isn't moral. Lois Martin, ttee of the Martin Family gust

It is my understanding that the Federal Emergency Management Agency (FEMA) granted money
to the county to restore road and water to Kalapana Gardens, but the county chose to use the
money for an alternate project. In light of that fact, where does the county get off trying to raise
the taxes of property owners like myself when we can't even get to our property? I've been given
statements from the taxing authority in Hawaii saying that the value of our property is zero. How
can property without any value be taxed? I believe a moratorium should be placed on the taxing
of Kalapana Gardens properties until such time that the roadway and water service is restored.

I am a owner of property in Kalapana Gardens, and have owned the property and paid property taxes since
1976.
I strongly oppose the County Council's proposal to increase taxes for property in Kalapana Gardens. We have
not been able to access Kalapana Gardens since 1992 when the County erected a barrier blocking access to
the area after the lava flows.
PLEASE PLACE A MORATORIUM ON TAXES UNTIL ROAD AND WATER INFRASTRUCTURE HAVE BEEN
RESTORED.
The property owners of Kalapana Gardens are well aware of the fact that the County used money granted by
the Federal Emergency Management Agency (FEMA), for the restoration of road and water infrastructure, for
an alternate project. As a taxpayer for property in Kalapana Gardens for the past 25 years, on property where
I had planned on building a retirement home, I find that the actions of the County with funds designated for
Kalapana Gardens have been dishonest and a good example of politics that are rotten to the core.
PLEASE VOTE FOR A MORATORIUM ON THIS PROPOSED TAX INCREASE.
