SUBJECT : MARIJUANA ERADICATION MISSIONS FOR THE MONTH OF
SEPTEMBER 2001
The Hawaii Police Department conducted marijuana eradication missions on
September 10 and September 24-28, 2001, in East Hawaii.
As required by Resolution No. ~6-01, reports indicating the number of plants eradicated
and the number of complaints received from the public, the type of complaint and the
complaint disposition are attached. Also included is a complaint we received on
September 19, 2001, which is not related to our mission.

Caller stated she has a new buffalo on her property and the gate securing the fence was damaged
during our last mission (August 24, 2001). Caller stated that she did not have the opportunity to
complete the property claim and the gate is still broken. Caller stated that a helicopter was flying in
the area for approximately 20 minutes.

Caller said choppers flying low and spraying and making a lot of noise that it's "driving me totally
crazy." Caller is a veteran and will be admitted to Trippler Hospital tomorrow. Caller said he did not
pay attention to what color chopper was. Told caller we are not spraying and that he could check with
DLNR if they are spraying. Caller said he did not want to check andrf something could be done about
it.

CONTINUATION
Researching prior complaints, I obtained the complainant's name and telephone number.
On 09-25-01 at 1145 hours, I recontacted the complaint to ohfer assistance. I identif€cd
myself and informed the male party who answered the telephone that the police ~,vould
not be able to transport anyone to the hospital but rescue personnel could be notified, I
then overheard him asking a female party if she wanted to go the hospital. She informed
him that she did not want to go to the hospital and would put on her earphones.
I then tried to get information regarding the complaint from the male party. He informed
me that at approximately 1045 hours a helicopter flew over his residence at a low
altitude. I-Ie was unable to estimate the altitude although stated his house shook.
The male party then continued to compaann about helicopters in the area, in general, at
which time I tried to redirect him to the specific complaint, in attempt to identify the
responsible helicopter and obtain the length of time the helicopter was in the area, The
male party continued to complain about helicopters flying in the general area. IIe further
explained that they were taking pictures. I then inquired if a copy of the photographs
could be sent to me. fie agreed.
During the conversation, the male party informed Yne that a military type helicopter had
returned. I-Ie stated that the helicopter appeared to have landed near a residence a~aith
construction workers on the roof and the construction workers scrambled o~thc roof. He
estimated the helicopter to be about 2000 yards away from his residence.
The Field Officer in Charge was informed of the complaint and officers were advised to
vacate the area.
At 1240 hours, I attempted to contact the complainant to inform her that all officers were
advised to vacate the area. Upon answering the telephone, the female party stated she
hated me and hung up the telephone.
At 1340 hours, the female caller recontacted me and apologized for her rude behavior. I
informed her that we have no intention of creating hardship for her and we are willing to
work out the problem. I informed her of a previous conversation that we agreed that she
would send me a diagram of the area in concern and we would limit our flights over the
area, ~1Ve also agreed that upon their inquiry, we would verify if we are flying in the area
and vacate the area for a reasonable time allowing them to move their patients indoors
and provide them with earphones to listen to music. I again requested a diagram of the
area and indicated that we would be snore than e~villing to find a compromise.

CONTTNIJATION
During the conversation, the female party informed me that while the helicopters were
flying over her residence an employee of Ban-nix Medical Supplies was replacing
oxygen tanks and observed the helicopters. As our conversation continued, I inquired the
name of the medical supply company. The female party immediately asked if I was
going to contact them and if I did not believe her. I infort~ed her that I was investigating
her complaint and wished to speak to all the possible witnesses. She then informed me of
the company name, fan-nom, although was unable to provide a correct spelling or
telephone number.
Detective B. SHIMABUKURO was assigned to contact and interview the construction
workers. At l 400 hours, he informed me that no one was at the construction site and a
message was posted for them to contact me. I was never contacted by anyone.
On 09-26-01 at 0730 hours, I attempted to contact the complaint to inform them that we
would be flying in the Ha~nalcua area agave. No one answered the telephone and a
message was left. 1 did not receive any return call or complaint throughout the day.
Detective SIdIMABUKURO was assigned to return to the construction site near the
complainant's residence to interview any construction worker.
Det. SI-III~~ABUKURO reported that no one was in the area. and the notes left by him
were still posted.
On 09-27-01 at 1145 hours, I contacted Alex YAGIN, Ban-nix Home Medical
Equipment, who informed me that he delivered oxygen tanks to a residence in Papaaloa
Mauka and Papaaloa during the morY~ing hours of 09-25-O1.
YAGIN informed me that while in the Papaaloa area he observed two helicopters, one
green in color and the other, smaller, unknown color.
I thou informed him that I was interested in his observation while at the residence in
Papaaloa Mauka. YAGIN informed me that upon his arrival at the residence he observed
a female party taking pictures of the smaller helicopter in the distance. I asked him to
estimate the distance and he replied, "Pretty far. about 300-400 yards''.
He went on to state that while in the residence, he could hear a helicopter "in the
distance" and did not hear any loud helicopter noise. He further related that while in the
residence the female party was yelling on the telephone.
YAGIN then related that when he left the residence, he observed the green helicopter on
the makai side of the residence about 200-300 yards away.

CONTINUATION
On 9-28-01 at 0755 hours, I was contacted by Chris KORNET who informed me that she
has a house under construction in the Papaaloa area and found a note to contact me.
I informed KORNET that I was investigating a complaint about helicopters in the area on
09-2S-O1 anal would like to speak to any construction workers that may have witnessed
the incident. KORNET related that no construction workers were at her property on 09-
25-0 ] . She went on to state that a residence further mauka is also under construction.
On 09-28-01, Det. I3. SI-IIMAI3UKUR0 was assigned to conduct a check of the area,
further rrca~~ka, and interview the construction workers, regarding this incident. Det.
SfIIMA~UKURO completed this assignment on 09-28-01. For further information, refer
to attached report submitted by Det. SIIIMAI3IJKiJitO.
On 09-28-01 at 1209 hours, the female caller leift a message thanking me for the call on
the morning of 09-26-01.
On 10-01-01, I was contacted by Officer D. CANARIO, NH District, who informed the
that he was contacted by the female complainant in this incident who wished to file a
complaint that a DEA A,gcnt contacted her neighbor on Thursday, 09-27-01. She stated
that he had a "DEA" shirt on but did not present his identification.
I informed O~ CANARIO that no one from the Vice Section was in the Papaaloa area.
on 09-27-O1 and we have no control if the DEA is investigating her allegations.

09-29-01: Approximately 1130 Hours: I contacted Michael BARYON, at the residence
under construction off of Papaaloa Road.
BARYON said that he was on working on the roof when the military chopper flew by on
the mauka side of his residence. He estimated that they were at least 1800 feet away on
the mauka side of his house, which would make it even further away from the house with
the windmill. Said that he waved at the chopper as it flew by and that the noise did not
bother him. From looking up slope to where the chopper was flying he estimated it to be
flying at a height of 400 feet.
BARYON said that he did not go scrambling off of the roof when the chopper flew by.
BARYON said that he owns 300 acres of land, which goes up from his house towards the
tree line. He said that the police could fly around in the area of his property anytime that
they have an eradication mission.
BARYON said that the lady who resides in the house with the windmill came by that
afternoon ranting and raving about the helicopters. While she was doing this he just
stayed on the roof and continued to work. When I told him that the lady reported that he
went scrambling oflFof the roof when the chopper flew by. He said that he has known
her and her husband for the past ten years. He said that the lady is a "crack block". He
said that they're both "cracked".

Detective Harley HEE was assigned to contact the complainant. On 09-06-2001 at 1230
hours, Detective HEE went to the complainant's residence but the complainant was not at
home so a note was left for the complainant to call Detective HEE. On the complainant's
property, which appeared to be approximately one acre, there were two tents on the
mauka side of the property which appears to be his living area. On the makai side of his
property was a garden area, which was approximately 20 by 40 feet. There was an old
Rototiller next to the garden.
On 09-06-2001 at 1400 hours, the complainant called Detective HEE and informed him
that on 09-06-2001 at about 1130 hours, he was near his tents and his worker was using
the Rototiller in the garden. A helicopter came from the north about 200 feet above his
property and headed south. A few minutes later, the helicopter again came from the
north over his property heading south.
The complainant described the helicopter as a green helicopter and could not see any
identifying marks. The complainant stated that while his worker was using the
Rottotiller, the helicopter flew over his worker startling him and causing the Rottotiller to
run over his worker's foot. The Rottotiller swung around and the handle of the Rottotiller
struck his worker in the groin. The complainant stated that his worker did not need
medical attention but his pride was hurt more than being injured.
The complainant identified his worker to Detective HEE.
On 09-10-2001 at 0830 hours, Detective HEE called the employee, who identified
himself. The employee related that on 09-06-2001 at about 1130 hours, he was using the
Rottotiller on the complainant's property when a helicopter came from the north and
headed south, which appeared to be flying over 600 feet. The employee indicated that
the helicopter was an army green helicopter. A few minutes later, the helicopter again
passed over the property from the same direction, still flying at about the same height or a
little lower. The employee indicated that the helicopter was hovering near a ridge on the
west side of the complainant's property and that he was distracted while watching the
helicopter when the Rottotiller blade hit his foot. The Rottotiller then swung around and
the handle of the Rottotiller hit him in the groin. The employee indicated that he felt pain
to his foot and groin area; however, he did not have any visible injuries from this
incident.
The complainant stated that he believed the helicopter did not fly lower than 600 feet as
he knows that a football f eld is 300 feet long.
