Re: Violent Crime Unit Grant
Enclosed is a bill for an ordinance amending the Operating Budget by
appropriating a $102,000 Violent Crime Unit Grant from the State Department of
the Attorney General Crime Prevention and Justice Assistance Division. These
funds will be used to create a Violent Crime Unit by hiring and training two
evidence specialists and the construction of an evidence storage.
Also enclosed is the resolution to create these two (2) Police Evidence Specialist I
(Temporary) positions for the Police Department. These positions will be filled on
a limited term basis in accordance to ovailability of funds from the aforementioned
Violent Crime Unit Grant and are expected to supplement the crime lab and
detective staff.

Enclosed is a folder containing the Applicant's Manual. The folder contains the
instructions, forms, and certifications you need to complete the application. Please complete and
submit the application to the assigned specialist at least two (2) prior to the project start date. This

1. This project, upon approval, shall constitute an official part of Hawaii's Drug
Control and System Improvement Formula Grant Program established under Title
VI, Subtitle C, Part E, Subpart 1, of the Anti-Drug Abuse Act of 1988 (Public
Law 100-690).
2. Any grant awarded pursuant to this application shall be subject to and will be
administered in conformity with:
(a) general conditions applicable to administration of grants under Title VI,
Subtitle C, Part E, Subpart 1, of the Anti-Drug Abuse Act of 1988 (Public
Law 100-690), as amended, as applicable;
(b) conditions applicable to the fiscal administration of grants under Title
VI, Subtitle C, Part E, Subpart 1, of the Anti-Drug Abuse Act of 1988
(Public Law 100-690), as amended, as applicable;
(c) any special conditions contained in the grant award; and
(d) general and fiscal regulations of the Crime Prevention and Justice
Assistance Division.
3. Any grant received as a result of this application may be terminated, or fund
pa~rment may be discontinued, by the Crime Prevention and Justice Assistance
Division when it finds a substantial failure to comply with the foregoing
provisions, the application obligations or for non-availability of funds.

1. By signing and/or submitting this application or grant agreement, the
grantee, is providing the certification set out on the form entitled
Crime Prevention and Justice Assistance Division, Department of the
Attorney General, ~,~,tification ReQardir~g Drucr-Fr,ee worknlac~
Recxuirements (hereinafter referred to as the "AG/CPJAD Form #16).
2. The certification set out on AG/CPJAD Form #16 is a material
representation of fact upon which reliance will placed when the
Department of the Attorney General, State of Hawaii (hereinafter
referred to as "grantor") determines to subgrant federal funds to the
grantee. Pursuant to the contract which grantor will offer grantee in
the event a subgrant is awarded to grantee, false certification or
violation of the conditions set forth in the certification shall be
grounds for suspension of payments, or suspension or termination of the
subgrant. Such false certification of violation of the conditions
contained in the certification shall subject the State of Hawaii to
governmentwide suspension or debarment, which shall, in.turn, result ir_

I, HAWAII POLICE DEPARTMENT (hereinafter
referred to as "grantee" certifies that it will provide a drug-free
workplace by:
(a) publishing a statement notifying employees that the unlawful
manufacture, distribution, dispensing, possession or use of a
controlled substance is prohibited in the grantee's workplace and
specifying the actions that will be taken against employees for
violation of such prohibition;
(b) establishing a drug-free awareness program to inform employees
about:
(1) the dangers of drug abuse in the workplace;
(2) the grantee's policy of maintaining a drug-free workplace;
(3) any available drug counseling, rehabilitation, and employee
assistance programs; and
(4) the penalties that may be imposed upon employees for drug
abuse violations;
{c) making it a requirement that each employee to be engaged in the
performance of the grant be given a copy of the statement required
by paragraph (a);
(d) notifying the employee in the statement required by paragraph (a)
that, as a condition of employment under the grant, the employee
will:
(1) abide by the terms of the statement; and
(2) notify the employer of any criminal drug statute conviction
for a violation occurring in the workplace not later than
five (5) days after such conviction;
(e) notifying the Department of the Attorney General, State of Hawaii,
within ten (10) days after receiving notice under subparagraph (d)
(2) from an employee or otherwise receiving actual notice-of such
conviction;

(f) taking one of the following actions with respect to any employee
who is so convicted:
(1) taking appropriate personnel action against such an employee,
up to and including termination; or
(2) requiring such employee to participate satisfactorily in a
drug abuse assistance or rehabilitation program approved for
such purposes by a Federal, State, or local health, law
enforcement, or other appropriate agency;
(g) making a good faith effort to continue to maintain a drug-free
workplace through implementation of paragraphs (a), (b), (c}, {d),
(e} , and (f) .

With available grant monies awarded to the Department, these positions will
supplement the Crime Lab and Detective staff by assisting in the search, recovery,
preservation, and marking of physical evidence at the crime scenes. They will also
assist in examining evidence, including drugs, and alcohol, processing latent prints,
examining firearms and other duties handled by the Criminalises and Detectives.
The additional staff will complement our detectives at the crime scene with their
training and expertise, which will allow the detectives more time to conduct their
duties.
2. Can new duties be assigned to existing positions or handled in other way such as
short term contracts, etc.
These positions will be filled on a limited term basis in accordance to availability of
grant funds.

Current Criminalises are conducting all the duties that will be assigned to these
positions. Their workload will be reduced by the additional staffing, allowing them to
concentrate on the more difficult and time sensitive evidence. These positions will
be able to perform more routine work for the drug and alcohol related crimes.
4. Alternatives that were considered in lieu of new position. (Have technological
changes been considered?)
Continue with a staff of three Criminalises for the entire island.
5. Why were manpower needs not planned through budgetary process?
This is the ideal situation where we can test the pilot project using outside resources
to determine whether the additional positions will in fact complement our operations
and prove to streamline our caseload.
6. List other rationale or pertinent statements and data:
With the increase in the number of drug and alcohol related crimes, including
accidents, it is imperative for the department to take apro-active approach to assist
the Detectives in solving cases. With 22,575 reported or known cases to handle
island-wide in FY 99-2000, the additional staffing for the crime lab will be a big assest
to the detectives, criminalises, and patrol officers.
