Kahawaiola'a, a native Hawaiian as defined under <br /> the HHCA, 1920 as amended July 9, 1921, Pub. No 34, 42 c 42 <br /> Stat. 108 and a resident of Keaukaha, lands having the status of <br /> Hawaiian Home lands. <br /> I must vehemently obj~~~ to the actions taken by several <br /> committee members on November 20, 2001, in which your actions <br /> clearly violated the Hawaii county charter, the State/Federal <br /> compact Article XII, ~1, ~2 and §3 and the oath taken at the <br /> time of your election, wherein you swore are oath to uphold the <br /> constitutions of Hawaii and the United States. <br /> <br /> After having been made aware that the County of Hawaii does not <br /> have the fundamental document in its possession, the consent of <br /> the United States to "increase the encumbrances on lands having <br /> the status of Hawaiian Home lands", your actions along with <br /> other participants from the present administration of the County <br /> of Hawaii, in its Mayor Kim, Finance Director William Takaba, <br /> Corporation counsel and the DHHL, Ben Henderson, voted at the <br /> committee level to continue the conspiracy of diverting the <br /> "proceeds and income derived on Hawaiian Home lands", into the <br /> county's general fund, through the county's real property tax <br /> ordinances, rather than for the expressed purposes of the Act. <br /> I hope you would reconsider your actions and be willing to <br /> address and provide the consent of the United States and the <br /> fundamental document that shows the title of these lands have <br /> been conveyed to the county of Hawaii, for without it, you <br /> continue to be in violation of your oath of office, as others <br /> h been in the past. <br /> erg' i ~ <br /> atrick Kah waiola' a <br /> ative Hawaiian ~SrtBe~. <br /> ~'ie~ Imlo., <br /> ~f. ~o: <br /> ter.
