In 1977 the Hawaii Coastal done Management (CZM) Act became law and incorporated <br /> <br /> many o~ the ~eatures o~ the Shoreline Protection Law. Both the CZM and the SMA laws Ynan- <br /> date policies ~or the management o~ Hawaii's coastal resources with special concern for the over- <br /> all well-being o~ OuY Ye3ldents and visitors. The Kohanailti Legal Decision, Public Access Shore- <br /> line Hawaii (PASH) and Angel Pilago, resulted ¢rom the implementation o~ the CAM and the <br /> SMA. This decision rendered by the Hawaii Supreme Court in 1995 unanimously upheld the <br /> validity o~ native Hawaiian gathering rights as well as consideration of the impacts o~ develop- <br /> ment on our community during the SMA permit proceedings before the County o~ Hawaii Plan- <br /> ning Commission. The decision spol.e to flee governments' duty toward protecting those rights. <br /> As stated in the County General Plan, it's goals and objectives are to uphold these policies <br /> and to: <br /> • Protect and conserve the natural resources [of the County of Hawaii) ¢rom undue <br /> exploitation, encroachment and damage. <br /> • Provide opportunities ~or [the public to ~ulfill) recreational, economic, and educa- <br /> tional needs without endangering natural resources. <br /> • Protect and promote the prudent use o~ Hawaii's unique, ¢ragile, and signi¢icant <br /> environmental and natural resources. <br /> • Protect rare or endangered species and habitats native to Hawaii. <br /> • Protect and effectively manage Hawaii's open space, watersheds, shorelit~ and <br /> natural areas. <br /> By adopting the proposed Cdpen Space revisions, the County will have an opportunity to <br /> ~ulfill it's obligation and uphold these goals and objectives and help us to protect Kohanailti and <br /> adjoining Kalol=o-Honolzohau National Part= ¢rom the impacts o~ development.
