HMMA supports all medical marijuana patients in the state of Hawaii. The recent raids
on medical marijuana patients have had a profoundly negative impact on them, as
patients. Most are dealing with absolutely overwhelming medical issues. Few have
previous growing experience in a war zone, which is what our once beautiful state has
become. Medical marijuana patients have found relief in the plant and grief in the
community. Now we must fear the police, as well as the rippers. Patients need to consult
with their doctors, not the police. Their right to privacy should not be violated. First and
foremost, each patient needs an adequate supply of quality marijuana, not leaves or
immature buds. This amount varies from patient to patient, and that fact should be
respected by those in law enforcement and government.
This confusion is easily cleared up. Police need to help patients, instead of harm them.
We are legal growers after all, using cannabis to case suffering. The issue of mature
plants is patently ridiculous. The plants follow a season and the longest season is
summer. What exactly are we supposed to do when our immature plants begin to flower,
just as nature dictates? They are not mature until October in any event. Most patients are
scrambling to have any smokable buds, especially in the summer.
A mature plant, from the point of view of the patient, is clearly one that is ready to smoke
and that is at least 2-3 months after flowering begins. The police should have a hands-off
approach to pulling all of our plants. Seven plants should be left alone for each medical
marijuana. patient. We propose that in the last event, police could issue a simple warning
that too many mature plants were found. The reason for this is simple. As soon as plants
are pulled, the issue is moot. Then they become drying marijuana.
To harass patients by taking their medicine using strong-arm tactics is unconscionable,
whether by the police or rippers. The effect on the entire community of patients is to
increase fear and mistrust. After all, we registered so that we would not have these types
of problems from the government. Police should make medical marijuana patients their
lowest priority since we are already legal, according to the State.
One way to insure an adequate supply and to overcome rip-offs is to have a cooperative
effort. Patients often fear growing in their own homes. Perhaps HMMA could be a part
of establishing a safe, secure environment for patients to grow without fear from either
the police or rippers. Security is of the utmost concern to all medical marijuana patients,
especially after the strong-arm robbery in Kapoho, and the recent police raids. LIMA
accepts donations for distribution to medical marijuana patients, as well as use it to
provide emergency medical marijuana assistance. We do this quietly for the benefit of
patients.

"Who are we to trust?" has become the mantra of medical marijuana patients. Some are
even letting their licenses lapse without renewal, citing them as worthless because the
license identifies where we are growing, making it easy for police to find us. The
harassment by police has directly caused this justified fear on the part of legitimate
patients. If this continues, it is only a matter of time when police cause a medical
emergency by causing medical harm to a patient while pursuing their interpretation of the
law. Police need to remember that these people are patients, and legal users of pot.
Lawsuits are already being filed on behalf of medical marijuana patients. This seems
entirely senseless. We should be concentrating on an adequate supply for all medical
marijuana patients year-round. If our program is run so well that all patients have an
adequate supply, then law enforcement could see a different outcome in this area. Hawaii
is one of the few places on earth that could do this for our patients in a beautiful and
caring way.
A dialogue is good, but actual changes are needed. This is a new program. Hawaii is a
great state and this could well be a model program. Give us a chance to make this work
by calling off the heavy tactics, and helping protect our rights as patients, and caregivers.
HMMA stands ready to provide expert advice and support in this arena, to the patients,
the government, and our community at large. We are citizens, not criminals.
You have nothing to fear from the medical marijuana community. Our only desire is to
be able to grow our plants without fear, and to use them to heal and ease patient's
suffering. Tell the police to respect our privacy, and help the patients, not terrify us. Our
community statewide is diverse, and the issue of marijuana is not new. HMMA seeks
what is just and fair for all of our patients, and we hope to do this in a spirit of laulima
with aloha. We believe in the generosity of Hawai= and our ability to come together as a
community and provide an approach that is entirely beneficial to our patient's healing
and general sense of well being. To do this, we rely on you as a representative of
government to kokua in this endeavor.
Specifically, let's meet regularly to discuss how better to serve this growing medical
marijuana community. HMMA proposes a meeting to discuss and implement security
measures for patients as a top priority.

HONOLULU -- The Americaii Civil Liberties Union of Flawai'i (ACLU) and the Drug Policy
Forum. of HaNvai' i (DPFH) today joined a chorus of voices throughout the state protesting the
unwarranted harassment of legally registered Big Island patients who use medical marijuana.
"Since July 8t6 there have two raids on Big Islanders who hold medical marijuana cerliadcates
issued by the Department of Public Safety," said Donald Topping, President of DPIFH. "This
intrusive b+ehaNior on the part of the Hawaii County police is an unconscionable atta:A� on sick
people who have been certified by a physician and are using marijuana legally to treat their
ailments."
ACLU Legal Director Brent White deplored the "out of control" behavior of the police who last
week arrested three patients in North Dona, one of whom had just returned from a two week bout
of chemotherapy on Oahu,
In the second raid. in the Puna district; a police officer rappelled from a helicopter and destroyed
3 of 7 plants that were growing in the patient's yard. In both cases the police alleged that the
patients had more than the legal number of plants. State law permits 3 `mature" plus and 4
"irnmatweones per registered patient. Patieat advocates, as well as botanists, belio�e it is
inappropriate for police officers to make This detet;mination.
White and -Popping noted that Big Island ?•Iayor Harry Kim signed two sets of rules on July 19`b
which govern procedures for cannabis eradication and for medical marijuana claims. The
signing took place atter the raids and vas likely designed to mollify public opinion which laas
been strongly critical of the police activities. Despite the signing, residents of Puna. Palisades
plant to deliver a petition to Mayor Kim today protesting the police behavior.

Palisades, in response to the extremely intrusive
helicopter "green barvest" incident of the morning of
July 18 2002, do respectfully make the following
request: If, in the future, it becomes necessary for the
DEA, Hilo Vice, Hilo Police, or any other law
enforcement agency to make an incursion into Puna
Beach Palisades that it be done from the ground. The
low level flying of helicopters as support for law
enforcement agents is intnisive beyond measure,
conjures up very strong community resentment, and
is simply unnecessary in an easily accessed
subdivision such as ours.

To our fellow Big Island residents:
As you may be aware, there has been a lawsuit filed on our
behalf in the Third Circuit Court of Kona. We are American citizens,
we are given certain rights and certain freedoms as American
citizens. A number of these have been violated against us. We
stand here today to encourage you to educate yourselves and the
ones you love regarding your rights and your freedoms. In times like
this, where we face our very own government agencies against us,
invading our privacy, attempting to strip away any dignity we may
have left, we need to start holding these individuals and agencies,
alike, accountable for their actions. We have constitutions, and we
believe that they are meant to help regulate agencies such as these
and to protect the people of this country from enemies both foreign
and &Mgglic.
What has happened to us can happen to anyone, and again
we express to you to know your rights as individuals. Unlawful
arrests (liberty), unnecessary trauma (mental and emotional),
blemished identities (confidentiality), private and confidential
medical conditions announced and last but not least, time lost.
But through all this God has shown us the peace that surpasses
all understanding. Community support is very welcomed and very
appreciated. We encourage you to write to your representatives, to
your local officials, express your concerns in our communities, testify
and speak at every opportunity given. Don't let patients be the IM of
the new laws.

This press conference was called by HAMMA and the Religion of Jesus Church
to call attention to the recent subversion of Hawai'i state law and constitution by
Hawai'i state and county law enforcement. We want to bring to the attention to offi-
cials and citizens a crisis of confidence, trust and good faith on the part of patients and
their families who many now believe that Hawai'i state law is and has been violated
by heavily armed men seemingly intent on gutting our basic rights and Hawai'i state
law.
Today, in coalition with other members of the Big Island community we present
petitions gathered only within the last week. Also presented is a video tape recorded
by Rhonda Robison in the course of her, her husband's and houseguest's cruel and
illegal apprehension by Hawaii County Police. We also have a copy of their lawsuit,
mailed Monday and expected to be filed today, in the Third Circuit Court in Dona by
their attorney Jack Schweigert (phone: 808 533-7491). We anticipate more lawsuits
to follow. We also have a draft of a resolution for the Hawaii County Council calling
for an immediate suspension of this county's participation in the Cannabis Eradication
Program over private and/or residential land. We also call upon the County to order the
police to deprioritize and cease intrusion, confiscation and arrests for small amounts of
marijuana grown on private residential property.
The HAMMA was created to protect and expand the rights of all medical mari-
juana patients in Hawaii and to work to fulfill the Hawaii state law of providing an
"uninterrupted and adequate supply." It has a website that can be found at:

1. Plaintiffs are residents of Kona and were so at all
times relevant to this proceeding.
2. Defendant Mark Farias is a police officer for the

this proceedings.
3. Defendants John Does 1-10, Jane Does 1-2.0, Doe
Partnerships 1-10 and Doe Corporations 1-10 (hereinafter

because their true names and capacities, whether individual,
corporate, associate or otherwise, are unknown to Plaintiffs, but

were in some manner engaged in the activities alleged herein;
and/or were in some manner responsible for the injuries and
damages to Plaintiffs. When the true names and capacities are
ascertained, Plaintiffs W? 1? ask leave to ar'erd tiffs Complaint to
state their true nares.
4. On or about July 8, 2002, Defendant Farias and HOED
invaded Plaintiffs right of privacy by coming onto their property
and unlawfully arresting them against their will and without
their consent on criminal charges of promoting a detrimental drug
based on marijuana found by Defendants growing on their property.
5. The Plaintiffs are authorized by H.R.S. § 329-122 to
grow and possess marijuana used as medicine for treatment of
their serious debilitating illnesses.
6. As a consequence of this arrest Plaintiffs were taken
to the police station and detained against their will and without
their consent for several hours. This conduct was a false arrest
and caused Plaintiffs to suffer injury entitling them to damages
in an amount to be proven at trial.
7. At the time of their false arrest, the Defendants also
wrongfully and unreasonably confiscated Plaintiffs' medical
marijuana they were otherwise authorized to possess causing them
to suffer injury entitling them to damages in an amount to be
proven at trial.
8. Defendants' false arrest of Plaintiffs and the wrongful
confiscation of their marijuana caused Plaintiffs to suffer
emotional distress.
9. Defendants, conduct towards Plaintiffs was reckless,
oppressive, insulting, and: indifferent to their rights and
medical needs and done without probable cause so as to justify an

award of punitive damages.
WHEREFORE PLAINTIFF'S PRAY that the Court enter judgment in
their favor and against Defendants, awarding then their damages,
including an award of punitive damages, as well as ,pre -judgment
interest, and such other and further relief as the Court may deem
just under the circumstances.

Resolution and Ordinance
Whereas the County of Hawaii is in a budgetary crisis and,
Whereas The Hawaii County Police department in the overzealous efforts to eradicate Cannabis has
incurred lawsuits costing further taxpayer moneys caused numerous complaints and loss of citizens
privacy and peace and,
Whereas The State of Hawaii has passed legislation allowing the medical use of Cannabis and,
Whereas it is extremely difficult for eradication officers to distinguish a medial Cannabis grow site via
aerial observation and,
Whereas the Hawaii State Constitution provides for privacy in article one section six and for the pursuit
of happiness in article one section two and freedom of religion in article one section four and Cannabis
eradications in private residential locations has violated these citizens rights and;
Whereas the privacy provision of the State Constitution was drafted with specific language with the
intent of preventing the arrest of any individual in the privacy of their home from being arrested for the
use of Cannabis and;
Whereas there is a limited amount of taxpayer dollars to fund the Hawaii County Police department
and;
Whereas there is an epidemic of methamphetamine use on Hawaii island needing all police and law
enforcement resources which are misspent on manini Cannabis crimes
It is hereby resolved that no County police officer or Prosecuting attorney shall arrest or prosecute any
Cannabis offense less than 25 plants on private residential property, nor shall any county officer or
agent participate in Cannabis eradication efforts over private and or residential land, nor shall any
county resources be utilized by any state or Federal agency or agents in the persecution of cannabis
users or eradication missions
Also any county officer or agent who violates this ordinance shall be fined between $500 and $1000 per
attempted Cannabis arrest or destruction of less than -25, plants or confiscation of less than 1 LB of dried
Cannabis, there being no indemnification for any county agent or police officer with regard to the
offenses of this ordinance that any fine incurred shall be the sole and personal responsibility of the
participating officer or agent of the county of Hawaii
This resolution and ordinance is in no way a legalization of Cannabis
The purpose of this ordinance is strictly to place the arrest and or prosecution of manim Cannabis
crimes at the lowest order of priority that police and prosecutor taxpayer moneys be redirected toward
all the hard drug crimes occurring in Hawaii County,
