Division 11. Nonconforming Signs <br /> Section 3-35. Signs erected prior to the effective date of this chapter. <br /> <br /> (a) Any sign erected prior to the effective date of this chapter, in compliance with all then <br /> <br /> existing statutes, ordinances, and regulations, and for which a legal permit had been obtained, is <br /> permitted to be maintained as a nonconforming sign until such time that the sign is altered, <br /> relocated, or the business is sold, at which time it must be removed or brought into compliance <br /> with all provisions of this ordinance. Any person who fails to comply, as indicated in Section <br /> 3-36 (Violations) and Section 3-38 and 3-42 (Criminal prosecution and Administrative <br /> enforcement) shall be sentenced to pay a fine of $100 per day from the date of notification of <br /> noncompliance by the director. During the time a sign is permitted to remain as a <br /> nonconforming sign, it is subject to the following conditions: <br /> (I) A nonconforming sign shall be maintained in a safe condition and shall not in any <br /> respect be dangerous to the public or to property. <br /> (2) Upon the alteration or relocation of a nonconforming sign or the discontinuance or <br /> removal from the premises of the activity to which the sign relates, the sign ceases to be a <br /> nonconforming sign and shall thereafter be allowed to be maintained only upon compliance <br /> with this chapter. The term "alteration" does not include repairs and maintenance for the <br /> purpose of keeping the sign in a clean and safe condition. <br /> Division 12. Violations, Enforcement, Penalty <br /> Section 3-36. Violations. <br /> Failure to comply with any provision of this chapter, any rule adopted pursuant to this chapter, <br /> or with conditions imposed as part of any permit or variance from the provisions of this <br /> chapter, shall constitute a violation of this chapter. <br /> Section 3-37. Enforcement. <br /> (a) The director shall enforce this chapter. Whenever necessary, any official of another <br /> department of the County shall assist the director, if requested, consistent with the usual and <br /> customary duties of the official's department. <br /> (b) When the condition of any sign creates an immediate hazard and peril to public safety or <br /> to property, or is illegally placed within any public right-of-way the director may remove the <br /> sign summarily and without notice. <br /> 19 <br /> <br />
