COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 14 03 <br /> RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN <br /> <br /> AGREEMENT WITH THE HAWAII STATE EMERGENCY RESPONSE <br /> COMMISSION AND STATE CIVIL DEFENSE TO ESTABLISH THE FRAMEWORK <br /> FOR FUNDING OF THE PROJECT TO UPDATE THE EMERGENCY RESPONSE <br /> PLAN OF THE HAWAII COUNTY LOCAL EMERGENCY PLANNING COMMITTEE <br /> WHEREAS, pursuant to Hawaii Revised Statutes 128E-5, the County of Hawaii has <br /> established a Local Emergency Planning Committee (LEPC) to work with the Hawaii State <br /> Emergency Response Commission (HSERC) to plan and set policy regarding potential problems <br /> involved with hazardous materials; and <br /> WHEREAS, the funding for the update of the local emergency response plan is provided by <br /> the HSERC and by the U.S. Department of Transportation Hazardous Material Emergency <br /> Preparedness Planning grant through the State Civil Defense; and <br /> WHEREAS, the annual Memorandum of Agreements between the HSERC, State Civil <br /> Defense, and the Hawaii County Local Emergency Planning Committee establishes the framework <br /> for funding of the project to update local emergency response plan of the Hawaii County LEPC; and <br /> WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain <br /> the consent of the council to enter into agreements with the federal or state governments respecting <br /> action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any <br /> funds or other assistance in connection with projects being or to be undertaken pursuant to those <br /> powers. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII <br /> that the Office of the Mayor is authorized to enter into an Agreement with the Hawaii State <br /> Emergency Response Commission and the State Civil Defense. <br /> <br />
