Arakaki, Chairman <br /> and Members of the County Council <br /> County of Hawaii <br /> 25 Aupuni Street <br /> Hilo, HI 96720 <br /> Dear Chairman Arakaki and Members: <br /> Planning Director Initiated <br /> Amendments to Chapter 25 (Zoning Code), Hawaii County Code 1996 <br /> Relating to Section 25-5-7 Minimum Yards in the Single Family <br /> Residential (RS) District and Section 25-5-26 Minimum Yards in the <br /> Double Fames Residential (RDl District <br /> The Planning Commission, after a duly held public hearing on March 20, 1997, voted to forward <br /> a favorable recommendation on the proposed amendments to Chapter 25 (Zoning Code), Hawaii <br /> County Code 1996, relating to Section 25-5-7 Minimum Yazds in the Single Family Residential <br /> (RS) District and Section 25-5-26 Minimum Yazds in the Double Family Residential (RD) <br /> District. The intent of the amendments is to delete reference to story for a building under the <br /> minimum side yard requirements within the above-mentioned zoned districts. <br /> When reviewing a building plan, the Planning Director is particularly concerned with the <br /> physical mass of the structure in relationship to the building site and boundaries and not so <br /> much the interior levels of the structure. There are concerns as to what is considered a story <br /> wherein a building may be constructed as tri-levels or the like, i.e., the three portions of a <br /> building are interconnected with one, two or three steps. To delete reference to story would <br /> still be consistent with the intent and purpose of minimum yard requirements which are to <br /> ensure that adequate air and light circulation is sufficient between structures. <br /> <br />
