B PDZon01.agk-3/14/97 <br /> COUNTY OF HAWAII PLANNING COMMISSION <br /> BACKGROUND REPORT <br /> PLANNING DIRECTOR INITIATED <br /> PROPOSED AMENDMENTS TO CHAPTER 25 (ZONING CODE), <br /> HAWAII COUNTY CODE 1996 <br /> - The following are the proposed amendments to Chapter 25 (Zoning Code), Hawaii <br /> County Code 1996, relating to Section 25-5-7 Minimum Yards in the Single Family <br /> Residential (RS) District and Section 25-5-26 Minimum Yards in the Double Family <br /> Residential (RD) District. The intent of the amendments are to delete reference to story for a <br /> building under the minimum side yard requirements within the above-mentioned zoned <br /> districts. <br /> As defined in Chapter 25, Zoning Code, "'Yard' means an open space on the same <br /> building site with a building, which open space lies between the building and the bounding lot <br /> lines, and is unoccupied and unobstructed from the ground upward except for landscaping and <br /> except for fences, walls, architectural features, pools, porte cocheres, cornices, canopies, roof <br /> overhangs, eaves, porches, balconies, terraces, fire escapes, stairs, ramps and other similar <br /> features ..." In addition, the intent and purpose of requiring minimum yards are to assure that <br /> adequate air and light circulation is sufficient between structures. <br /> 1. Section 25-5-7 of the Zoning Code is amended to read: <br /> Section 25-5-7. Minimum yards. <br /> (a) The minimum yards in the RS district shall be as follows: <br /> (1) On a building site with a required area of seven thousand five hundred <br /> square feet to and including nine thousand nine hundred ninety-nine <br /> square feet: <br /> (A) Front and rear yards, fifteen feet; and <br /> (B) Side yards, eight feet[for a one story building, and ten feet for a <br /> two-story building]. <br /> (2) On a building site with a required area of ten thousand square feet to and <br /> including nineteen thousand nine hundred ninety-nine square feet: <br />
