Pavao, Manager <br /> SUBJECT: WATER COMMITMENT POLICY <br /> This letter is in response to your request for clarification of the Department's <br /> water commitment policy, and more specifically, in relation to Change of Zone <br /> Application No. 94-032. <br /> Water commitment(s) is/are granted by the Department for the developer's specified <br /> unit(s) of water. This/These unit(s) is/are further defined in our rules as <br /> number of lots, dwelling units, or equivalent units. Each equivalent unit of <br /> water is currently determined by this Department as 600 gallons per day which is <br /> the maximum daily demand factor. <br /> A commitment, which is secured by the applicant's payment of a $150.00 water <br /> commitment deposit (WCD) for each additional unit, provides assurance to the <br /> applicant that water is and will be available for the proposed development. The <br /> first equivalent unit or any existing lot, in the case of a subdivision, is exempt <br /> from the payment of a WCD. <br /> Once granted by this Department, the initial commitment(s) is/are valid for a <br /> period of three (3) years. Any subsequent water commitment extension request, if <br /> water is available, can be approved fora period of one year upon the payment of <br /> an additional 8150.00 WCD per additional unit. Please refer to the enclosed <br /> copies of the Water Commitment Guidelines Policv and Rules and Regulations <br /> Rule 5 for more specifics. It should be noted that all WCD would be credited <br /> towards the final facilities charge. <br /> Change of Zone Application No. 94-032 (Tax Map Key 6-4-001:035) proposed a change <br /> from A-40a to FA-3a that would result in a 4-lot subdivision. Since this proposed <br /> zone change and subsequent subdivision will create three (3) additional lots, the <br /> required WCD would be 5450.00 (3 units/lots @ 5150.00 per unit). <br /> Although the Department has not specified when the WCDs are due, it would behoove <br /> the applicant to secure the water commitment as soon as possible. Water <br /> commitments are subject to the prevailing water availability. The ninety (90)-day <br /> deadline for payment of the WCD is a condition of the zone change ordinance that <br /> was imposed by either the County Council or the Planning Departmen~ ~0 30~.
