HomeMy WebLinkAboutRES 090 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 90 03 RESOLUTION AUTHORIZING THE ABANDONMENT AND SALE OF A PORTION OF THE ALENAIO STREET ROAD RIGHT-OF-WAY TO BALLARD MORTUARY WHEREAS, Alenaio Street is owned and maintained by the County of Hawaii as depicted on the map attached as Exhibit "A"; and WHEREAS, Ballard Mortuary is the owner of TMK:(3)2-3-018:054, which contains a building which encroaches onto the Alenaio Street road right-of-way; and WHEREAS, this stub out of Alenaio Street upon which a portion of Ballard Mortuary sits is no longer needed by the County of Hawaii, and the Department of Public Works and the Planning Department have agreed to the abandonment of this roadway stub out of approximately 383 square feet; and WHEREAS, adjoining property values have established a per square foot value of $7.85; and WHEREAS, all roadways, once established, continue until vacated, closed, abandoned or discontinued by resolution of the Council; and WHEREAS, Sections 2-111 and 2-118 of the Hawaii County Code permit the sale of remnants upon approval by the Council; and WHEREAS, the proposed remnant is less than 2,500 square feet. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the 383 square foot stub out of Alenaio Street as depicted on Exhibit "A" is declared to abandoned and otherwise discontinued as a road right-of-way, that it is physically and economically unsuitable or undesirable for development or utilization as a separate unit by reason of its location, size and shape, and is hereby declared a remnant as set forth in Section 2-110, Hawaii County Code, and pursuant to Section 2-111 and 2-118, authorize the disposal of the road remnant by sale to Ballard Mortuary, the adjoining landowner. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Steven S.C. Lim, attorney for Ballard Mortuary, Carlsmith Ball, P. O. Box 686, Hilo, Hawaii 96721-0686; (2) Finance Director William Takaba; (3) Planning Director Chris Yuen; (4) Director of Public Works Bruce C.
