According to the Flood Insurance Rate Map (FIRM), <br /> the project area is within Zone "X", areas determined to be outside the 500-year flood <br /> plain. The project area is also located outside of any tsunami inundation area. Any new <br /> construction or improvements to the project area must comply with Chapter 27 of the <br /> County Code relating to Flood Hazard Control. The subject property was formerly <br /> cultivated in sugar cane and therefore, no endangered or threatened species of floral or <br /> fauna or any archaeological sites aze anticipated to be found on the subject property. <br /> There is no record of a designated public access to the shoreline or mountain areas <br /> traversing the property. The State of Hawaii ALISH Map classifies portions of the azea <br /> near the Milo Street extension as Prime Agricultural Lands and the northern portion of <br /> the property is Unclassified. The Land Use Study Bureau's Overall Master Productivity <br /> Rating for the soils in the azea is "C" or "Fair." An 8.725-acre portion of the 23.626-acre <br /> property would continue to be available for further agriculture uses. Therefore, the <br /> change of zone for this azea will not be detrimental to the reduction of this azea from the <br /> agricultural land inventory in the County of Hawaii. The State Land Use Commission <br /> has expressed a concern that the State Land Use Law may be circumvented by allowing <br /> the 14.901-acre portion of the pazcel to be redesignated in the Urban district with the <br /> possibility of the remaining 8.725-acre portion to be redesignated Urban in the future. As <br /> such, a condition of approval will be included to require the applicant to include a <br /> restrictive covenant in the deed which states that the approximately 8-acre portion of the <br /> property in the State Land Use Agricultural district shall not be reclassified into the Urban <br /> district for 5 yeazs, unless the state land use law is amended to change the rule that <br /> amendments of more than 15 acres must be approved by the Land Use Commission. <br /> Based on the above findings, this request for a Change of Zone from an <br /> Agricultural (A-20a) to a Light Industrial (ML-20) and Agricultural (A-Sa) zoned district <br /> would result in an appropriate land use pattern and further the public convenience, <br /> necessity and general welfaze. <br /> <br /> The accompanying draft bill to amend Section 25-8-22 (Puna District Zone Map) is provided for <br /> <br /> your favorable consideration. <br /> <br />
