CARVALHO, POLICE CHIEF <br /> SUBJECT: ST%%ATEWIDE MARIJUANA ERADICATION TASK FORCE GRANT <br /> PROJECT N0. 96-DB-13 <br /> RESOLUTION NO. 94-97 <br /> This is in reply to your memorandum of August 24, 1998 asking <br /> whether the Police Department is obliged to comply with <br /> conditions imposed in a resolution. We respond in the negative. <br /> The Police Department reviews its various programs on a regular <br /> basis. We consider that to be part of our management <br /> responsibility. Such reviews, however, do not meet the <br /> requirements of Article III, Section 3-16 of the Charter, which <br /> clearly contemplates an independent outside review by the <br /> Council. <br /> While we respectfully do not acknowledge the authority of the <br /> Council to dictate the management practices of the Police <br /> Department by resolution, we will be happy to provide any data <br /> which the Council may need to assist in evaluating the <br /> effectiveness of the marijuana eradication program as indicated <br /> in our earlier memorandum of June 23, 1998 to the Legislative <br /> Auditor. <br /> WGC:sk <br /> cc: Mayor Stephen K.
