22. In fiscal year 2001-2002, beneficiaries, including but <br /> not limited to the following, have received funds from the <br /> Trust: <br /> • Department of Health, Hawaii District Health Office; <br /> • Na Keiki He'e Nalu 0 Hawaii; and <br /> • Hawaii County Office of Aging. <br /> See Aff. of the Director of Finance. However, this Trust is a <br /> charitable trust with no specific beneficiaries identified. <br /> Accordingly, the court has recognized that the Attorney General <br /> of the State of Hawaii is the proper party to represent the <br /> State of Hawaii and the public at large in their interest in the <br /> Trust. See Exhibit D, p. 5, X12. <br /> 23. The address of the Attorney General of the State of <br /> Hawaii is Hale Auhau, 425 Queen Street, Honolulu, Hawaii 96813. <br /> The Petitioner will provide notice of the Petition to the <br /> Attorney General, Mark J. Bennett, in his capacity as parens <br /> patriae. <br /> WHEREFORE, Petitioner prays that this Honorable court make <br /> and enter its Order: <br /> (1) Approving Petitioner's resignation as trustee of this <br /> Trust; <br /> (2) Appointing the Mayor of the County of Hawaii and his <br /> successors in interest, or another trustee as the Court deems <br /> appropriate, as successor trustee; <br /> (3) Vesting legal title in and to any and all properties <br /> <br /> 93995 3 $ <br /> <br />
