This <br /> Petition is filed pursuant to Hawaii Revised Statutes ("HRS") ~ <br /> 560:7-201 and ~ 554-1 and Rules 3 and 126 of the Hawaii Probate <br /> Rules. The Petitioner respectfully shows as follows: <br /> 1. This Trust was originally created without a formal <br /> written instrument in 1904 for the purpose of receiving and <br /> administering voluntary contributions from importers of goods on <br /> the Island of Hawaii to combat plague and otherwise further <br /> public health and safety on the Island of Hawaii. <br /> 2. In 1941, pursuant to a petition by the administrators <br /> of the Trust at that time, the court formally declared that the <br /> Trust was a charitable trust and that those who were <br /> administering it at that time were its trustees. Attached as <br /> Exhibit "A" is a true and correct copy of the Amended Decision <br /> in Ross v. Shippers Wharf Committee, Equity No. 301 (Jan. 11, <br /> 1941), in the Circuit Court of the Fourth Judicial Court, County <br /> and Territory of Hawaii. <br /> 3. In 1991, the court also formally described the <br /> purposes of the Trust and specifically instructed the trustees <br /> that the corpus and the income from the Trust may be used for <br /> the following objects and purposes "on the Island of Hawaii": <br /> 1. For all matters relative to safeguarding public <br /> health and improving public sanitation; <br /> 2.
