<br /> S. The applicant, its successors or assigns, shall be responsible for ensuring that the <br /> proposed passive park site is preserved, maintained, and cared for in perpetuity. <br /> <br /> T. The applicant shall purchase and install an Emergency Outdoor Warning Siren, <br /> acceptable to the Hawaii County Civil Defense Agency. An Emergency Response <br /> Plan shall also be submitted to the Hawaii County Civil Defense Agency for <br /> review and approval prior to receipt of final subdivision approval. <br /> U. The applicant shall comply with the County of Hawaii's Affordable Housing <br /> Policy pursuant to Chapter 11, Article 1, Hawaii County Code. <br /> V. The applicant shall contribute to the development, funding, and/or construction of <br /> school facilities, on a fair share basis, as determined by and to the satisfaction of <br /> the State Department of Education. Terms of the contribution shall be agreed <br /> upon in writing by the applicant and the Department of Education prior to <br /> obtaining building permits. A copy of this agreement shall be filed with the <br /> Planning Department. <br /> W. The Applicant shall make its fair share contribution to mitigate the potential <br /> regional impacts of the project with respect to parks, fire, police, solid waste <br /> disposal facilities and roads. The Fair share contribution shall be initially based on <br /> representations contained within the change of zone application and maybe <br /> increased or reduced proportionally if the lot counts are adjusted. The fair share <br /> contribution shall become due and payable prior to final subdivision approval for <br /> any portion of the property or its increments. The fair share contribution in a form <br /> of cash, land, facilities or any combination thereof shall be determined by the <br /> County Council. The fair share contribution maybe adjusted annually beginning <br /> three years after the effective date of the change of zone ordinance, based on the <br /> -7- <br /> <br />
