Pieasa
forgive this hastily written letter and accept my apology for not having sent In testimony In a more
timely fashion.
I have spoken on behalf of the endangered Hawaiian hawk, or'lo (buteo solitarius) and the
endangered Hawaiian hoary bat, or ope ape a (Lasiurus cinerus semotus) al three prior meetings.
I have presented information to show that both species are protected under the federal
Endangered Species Acl and that neither species is proposed to be de-listed any time soon.
I also presented evidence that both species use the Nani Kona Aina parcel to hunt over, roost on
and navigate over. Changing the parcel in any significant way will create substantial risk to their
wellbeing and thus would be a violation of the Federal ES law, which already protects them.
I also presented the information showing that I am working with the full support of the USF& W
service authorities based in Honolulu Hawaii. In addition I presented information sent to me by the
USFBW office to begin the process to identify and request further protection under Critical Habitat
designation. At this point I have submitted maps and am working on a study of the Hienaloli
drainage area, Which includes the Nani Kona Aina parcel.
I ask that you please take into consideration all of the past oral testimony I gave regarding these
Federally protected animals. My prior testimony gives detail into where the animals are and what
exactly is required for them to survive.
A line needs to be drawn and some areas just must be kept with low density so that the first
residents of Hawaii can continue to survive. The law is on their side, I ask you to allow reasonable
development and not approve either Bill that would create development with out the space the
creatures must have to live.
Sincerely, ~
Ann Goody, Curator
Comm.
