COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 232 04 <br /> RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN <br /> <br /> AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF HEALTH, <br /> PURSUANT TO HRS 46-7, FOR THE BEVERAGE CONTAINER DEPOSIT <br /> PROGRAM GRANT <br /> WHEREAS, the State of Hawaii Department of Health (DOH), by law, must implement the <br /> Beverage Container Deposit Program by January 1, 2005; and <br /> WHEREAS, under the Beverage Container Deposit Program, a redeemable deposit fee is <br /> collected on all eligible beverage containers in a effort to encourage recycling and reduce land <br /> disposal and illegal dumping of affected containers; and <br /> WHEREAS, a separate container fee is also collected by the State's DOH from the beverage <br /> industry for each eligible container and a portion of those container fees are then being distributed to <br /> the counties to assist in developing and monitoring public redemption centers; and <br /> WHEREAS, the State DOH, recognizing that it would be better to have each county be <br /> responsible for the development and monitoring of their own program, has authorized funding to the <br /> County of Hawaii for its Beverage Container Deposit Program; and <br /> WHEREAS, the County's Department of Environmental Management's Recycling Section has <br /> been requested to assume responsibility for implementing and monitoring the Beverage Container <br /> Deposit Program; and <br /> WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain <br /> the consent of the council to enter into agreements with the federal or state governments respecting <br /> action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any <br /> funds or other assistance in connection with projects being or to be undertaken pursuant to those <br /> powers. <br /> <br />
