Arakaki, Chairman <br />and Members of the County Council <br />Page 5 <br />Possible adverse effect or impairment of valued resources: In a letter dated <br />June 29, 2004, the Department of Land and Natural Resources -State Historic Preservation <br />Division issued a "no -effect' letter stating that they believe that there are no historic <br />properties present because residential development/urbanization has altered the land, <br />previous grubbing/grading has altered the land and an acceptable archaeological <br />assessment or inventory survey found no historic properties. Thus, they believe that "no <br />historic properties will be affected" by this undertaking. A condition will be included to <br />require the notification of the Department of Land and Natural Resources -Historic <br />Preservation Division (DLNR-SHPD) should any archaeological sites be encountered <br />during the course of development. <br />The botanical reconnaissance report concluded that "no rare, threatened or <br />endangered species as listed by the U.S. Fish and Wildlife Service was observed on or <br />near the property, which is basically already developed. The site in its developed <br />condition does not represent suitable habitat for threatened or endangered plant or animal <br />species, and further subdivision and development is unlikely to adversely affect such <br />species." <br />The property is not adjacent and/or proximate to the shoreline. As such, gathering <br />of marine life, fishing and coastal access is not an issue. <br />Feasible actions to protect native Hawaiian rights: According to the applicant, <br />portions of the project site area have been previously cleared. It would appear very <br />unlikely that the site would be used for gathering or associated with traditional and <br />customary Hawaiian practices. <br />Based on the above, the approval of the State Land Use Boundary Amendment to <br />the Urban District complements the State Land Use District Regulations and is supportive <br />of the State of Hawaii Plan. <br />Change of Zone <br />The applicant is requesting a Change of Zone for 1.8628 acres of land from an <br />Agricultural 5 -acre (A -5a) to a Single -Family Residential 20,000 square feet (RS -20) <br />district. The applicant is requesting the Change of Zone to allow the subsequent <br />subdivision of the property into three (3) 20,000+ square foot residential lots for her three <br />children. The applicant has concurrently submitted an application for a State Land Use <br />Boundary Amendment from the Agricultural to Urban District. <br />
