<br /> COUNTY OF HAWAII STATE OF HAWAII <br /> BILL NO. 327 <br /> (Dr~F-r z ) <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING ORDINANCE NO. 91 71, WHICH AMENDED <br /> ORDINANCE NO. 89-54, WHICH RECLASSIFIED 2.23 ACRES OF LAND FROM A <br /> MULTIPLE FAMILY RESIDENTIAL 1,000 SQUARE FOOT (RM-1) TO A RESORT-HOTEL <br /> 1,000 SQUARE FOOT (V-1) DISTRICT AT PUAA 2ND, NORTH KONA, HAWAII, <br /> COVERED BY TAX MAP KEY 7-5-9:40. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Ordinance No. 91 71 is amended as follows: <br /> "SECTION 2. This change in district classification is conditioned upon the following: <br /> (A) The applicant, successors or assigns shall be responsible for complying with all <br /> stated conditions of approval; <br /> (B) A Special Management Area (SMA) Use Permit application for the proposed <br /> development shall be filed with the Planning Deparhnent within one year from the <br /> effective date of this new amendment; <br /> (C) A drainage system shall be installed in accordance with the requirements of the <br /> Department of Public Works; <br /> Access to Alii Drive/Walua Road and Kuakini Hi~hway includine the provision <br /> of sight distances and the followine movement restrictions, shall meet with the <br /> approval of the Department of Public Works. 1. Movements allowed at the <br /> Kuakini Highway approach may be limited to right into and right out of the <br /> subiect property when future Kuakini Highway improvements aze made. <br /> 2 Movement restrictions along Alii Drive/Walua Road shall be determined when <br /> -1- <br /> <br />
