COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 264 Q4 <br /> <br /> A RESOLUTION AFFIRMING THE CONTINUED CIVIL SERVICE STATUS OF CERTAIN POSITIONS IN <br /> <br /> THE OFFICE OF THE COUNTY CLERK/COUNCIL. <br /> WHEREAS, in 1977, the State Legislature enacted Act 62, which amended Section 46-32, Hawai i <br /> Revised Statutes, by stating, in part, "the council of any county may appoint and employ personnel as <br /> it deems necessary and prescribe their powers, duties and compensation. All such personnel shall be <br /> exempt from the civil service and the position classification plan;" and <br /> WHEREAS, in 1977, all council employees were civil service with the exception of the county clerk, the <br /> deputy county clerk and the legislative auditor; and <br /> WHEREAS, as a result of Act 62, the Council subsequently converted some positions from civil service <br /> to exempt, created additional exempt positions, and retained several positions as civil service; and <br /> WHEREAS, prior to 1977 and continuing to present, the Office of the County Council/Clerk's Office has <br /> been staffed, in part, by the following civil service personnel: the council services supervisor positions <br /> (Position Nos. 1912 and 2445), council services assistant positions (Position Nos. 1957, 2448, 2570, <br /> 2633, 3861), and the legislative information and reference technician (Position No. 2280); and <br /> WHEREAS, these positions provide essential secretarial, informational and reference services to the <br /> Council and the Clerk as well as to other government agencies and the general public; and <br /> <br /> WHEREAS, these positions are, at the minimum, responsible for: <br /> • Complying with legal posting, notice and mailing requirements of the Sunshine Law; <br /> • Assisting in the proper preparation of council and committee agendas; <br /> Securing meeting facilities accessible for persons with physical disabilities; <br /> Making arrangements upon request for persons who need special accommodations at <br /> meetings; preparing council and committee minutes by the statutory deadline; <br /> Assuring the timely filing of financial disclosures required by law; <br /> Disseminating the Hawaii County Code and its supplements; <br /> Processing administrative rules of procedures with the Lieutenant Governor's Office, <br /> executive orders filed with the County Clerk, lobbyist registration and expenditure <br /> reports and claims against the County filed by law with the County Clerk; <br /> Recording appropriate deeds with the State Bureau of Conveyances; <br /> Maintaining and managing the Clerk's Office records system; and <br /> <br /> WHEREAS, these positions in the County of Hawai i have customarily and historically been performed <br /> by civil servants; and <br /> <br /> WHEREAS, the Council finds that it is imperative to have experienced, qualified clerical and technical <br /> resource staff that provide continuity and institutional knowledge to the Office of the County <br /> <br /> Clerk/Council; and <br /> <br />
