This stockpiling <br /> operation at the Hilo Coast Processing Pepeekeo Sugar Mill and power plant was <br /> considered a permitted use under the State Land Use Law and Zoning Code when the <br /> coal ash was burned with bagasse, a by-product of sugar cane cultivation. However, with <br /> the cessation of sugar cane cultivation operations, the stockpiling of coal ash is no longer <br /> permitted. In July 2003, this office gave Brewer Environmental Industries, LLC and <br /> Continental Pacific, LLC a temporary clearance for the stockpiling and removal of coal <br /> ash pending an application for a Special Permit to legitimize this coal ash stockpile <br /> operation. To date, we have not received this application. Further investigation has <br /> revealed the following: <br /> 1.
