<br /> 8. Copyright and Patent. No summary, report, map, chart, graph, table, study or
<br /> other document or discovery, invention, or development produced in whole or in part
<br /> under this Agreement shall be the subject of an application for copyright or patent by
<br /> or on behalf of the AWARDEE, its officers, its agents, its employees, or its
<br /> subcontractors without prior written authorization from the Director. It is strictly
<br /> understood that all finished or unfinished documents, reports, summaries, lists, charts,
<br /> graphs, maps, or other materials prepared by the AWARDEE and all discoveries,
<br /> inventions, or developments produced in whole or in part under this Agreement shall
<br /> be the property of STATE.
<br /> 9. Maintain Records. AWARDEE shall maintain statistical, clinical and administrative
<br /> records pertaining to services of this Agreement. The records shall be subject at all
<br /> reasonable times to inspection or review by STATE or Federal representatives directly
<br /> connected with the program azea under this Agreement. All records shall be retained
<br /> and made accessible for a minimum of three years after the date of submission of
<br /> AWARDEE's final nport to STATE. Except in the event any litigation, claim,
<br /> negotiation, investigation, audit, or other action involving the records has been started
<br /> before the expiration of the 3-yeaz period, AWARDEE shall retain the records until
<br /> completion of the action and resolution of all issues that arise from it or until the end
<br /> of the regular 3-year retention period, whichever occurs later. This requirement
<br /> replaces General Condition number 3.b., in Attachment 5.
<br /> 10. Drug Free Work Place. AWARDEE shall comply with the provisions of the Federal
<br /> Drug Free Act of 1988, Public Law 100-690 Title V, Subtitle D, which requires that
<br /> AWARDEE maintain a drug free work place.
<br />
<br /> 11. Nondiscrimination. AWARDEE shall comply with Title VI, of the Civil Rights Act
<br /> of 1964, as amended, 42 U.S.C. Sections 2000d et sea•, 45 C.F.R. Part 80 and
<br /> Executive Order 11246, as amended, which prohibits discrimination on the grounds of
<br /> race, color, religion, sex, or national origin, and shall also comply with Section 504
<br /> of the Rehabi]itation Act of 1973, as amended 29 U.S.C. Section 794, and 34 C.F.R.
<br /> Part 104, which prohibits discrimination on the basis of handicap, physical or mental,
<br /> in any program or activity receiving Federal financial assistance, and Age
<br /> Discrimination Act of 1975, 45 C.F.R. Part 90, prohibiting age discrimination in the
<br /> delivery of services, and Pregnancy Discrimination Act of 1978 prohibiting
<br /> discrimination in employment against women based on pregnancy and other related
<br /> conditions.
<br /> This provision shall include, but not be limited to, the following: employment;
<br /> upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or
<br /> termination; rates of pay or other forms of compensation; and selection for training,
