Background information on the history and intent of the fuel taz maintenance fund. The first fuel tax imposed upon Hawaii counties for the sale of gasoline and other liquid fuel was established in 1955 by Section 243-5 of the Hawaii Revised Statutes. Each County was prescribed a fuel tax, ranging from 1 to 3 cents per gallon, until otherwise amended by resolution adopted by the individual counties. The original County of Hawaii fuel tax was set at 1 cent per gallon. Section 243-5, HRS, further states, the amount of each County's fuel tax shall be determined by resolution and adopted by the Council in the manner provided by law relating to expenditures of public money. The amount fixed may be, per gallon, one or more cents or a fraction of a cent or both, or it may be zero. No such resolution shall be adopted until the Council shall conduct a public heazing on the amount of the proposed tax. In 1977 the Council increased the fuel tax to 5 cents per gallon. Most recently, the Council adopted Resolution No. 397-88 (attached) on March 15, 1988, which increased the tax by 3.8 cents per gallon. Resolution No. 397-88 was instrumental in creating the fuel tax increase expenditure plan, which provided for the expenditure of an anticipated $1.5 million in annual revenues. These revenues were to be utilized for road improvement projects over aten-yeaz period, delineated in five increments. This measure also established a district apportionment formula, to be updated biannually, based upon a percentage derived from each district's percentage of vehicle weight tax and road miles. Como< ]uw- ' O Y11eIfa.__ ND~tIP ~ prQSented F c_ Raf. riwdw tu1G $ 1907 f , Adopted on August 7, 1991 was Resolution No. 351-91 (attached), which amended the original fuel tax expenditure plan by providing for revenues in excess of the monthly projected amount to be available for allotment to circle-island or round-the-island roadways, and allowed the Chief Engineer to apply appropriations towazd the hiring of consultants for the prosecution of a pazticulaz project. It also modified the biannual update requirement of the distribution formula to biennial. Currently before the Committee on Finance is Bill No. 116, which appropriates lapsed funds from Increment IV, Bill No. 117, which establishes the district appropriations for the fifth and final increment of the fuel tax increase expenditure plan, and Resolution No. 130, providing the required biennial update. 2. What is the extent of powers/ability of the Council to change road schedule by a adding/subtracting roads on list? The Council has the power to add, subtract or even reprioritize projects by ordinance. Since the inception of the fuel tax expenditure plan project list, the Council has amended the list four times. The last such amendment was on February 24, 1993, which added the I{aumana Drive/Ainako Avenue intersection as a South Hilo district project. COUNTY OF HAWAII STATE OF HAWAII RESOLUTION No. 33? 83 (Draft 3) WHEREAS , the provisions of Section 243-5 , Hawaii Revised Statutes, enable, empower , and authorize the Council of the County of Hawaii to determine the amount of the County fuel tax; and WHEREAS, it is provided in said section that the amount of the County fuel tax shall be determined by resolution to be adopted by the Council in the manner provided by law, relating to resolutions involving the expenditure of public money, and the amount so fixed may be, per gallon, one or more cents or a fraction of a cent or both, or zero ; and WHEREAS , the said section further provides that no such resolution shall be adopted until the Council shall conduct a public hearing on the amount of the proposed tax after a notice of such hearing shall have been published in a newspaper of general circulation within the County at least twice during a period of thirty days immediately preceding the date of such hearing ; and WHEREAS , the existing County fuel tax imposed upon the sale or use of gasoline and other liquid fuel had been set ten years ago at 5 cents per gallon by Resolution No . 129 ( 1977) ; and WHEREAS, the Council, after considering the various and numerous highway needs and improvements to be made within the County of Hawaii, believes that the County fuel tax should be increased by an additional 3 . 8 cents per gallon, thereby making the aggregate County of Hawaii fuel tax for diesel on-highway , gasoline , and all others , 8 . 8 cents per gallon and for LPG on-highway, 6 .8 cents per gallon ; and WHEREAS , it is anticipated that the increase in the County fuel tax will generate a projected $1 . 5 million increase in highway fund revenues annually; and WHEREAS, it is the intent of the Council that expenditures of all revenues generated by the fuel tax increase be based upon the apportionment formula developed by the Department of Public Works and be used in accordance with highway improvement projects incorporated in Exhibit A, herein attached. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII : 1. That it does hereby fix, determine and set the amount of the County of Hawaii fuel tax to be levied and collected by the department of taxation of the State of Hawaii , in accordance with law, at 8. 8 cents for diesel on highway, gasoline on-highway and others and 6 . 8 cents for LPG on-highway . 2. That any and all increases in highway fund revenues generated by the fuel tax increase shall be expended for highway improvements as delineated in Exhibit A, herein attached. 3 . That said expenditures shall also be in accordance with a district apportionment formula based upon a percentage derived from each district 's % vehicle weight tax and % road miles. 4 . That said apportionment formula shall be updated bi-annually . BE IT FURTHER RESOLVED that this resolution shall take effect in accordance with provisions incorporated in Section 243-5 , Hawaii Revised Statutes and shall continue in effect for ten years . BE IT FURTHER RESOLVED that if any provisions of this resolution or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this resolution which can be given effect without the invalid provision or application, and to this end the provisions of this resolution are declared to be severable. BE IT FURTHER RESOLVED that the County Clerk be and he is hereby instructed and directed to send a copy of this resolution to the State Director of Taxation and State Director of Finance. Funds for projects listed in subsequent increments shall be allotted following the full allotment of funds for projects in the preceding increment . _ In the event revenues generated by the fuel tax increase exceed $15 million, the additional revenues shall be appropriated for highway projects as determined by the Council . -11- COUNTY OF HAWAII STATE OF HAWAII RESOLUTION No. 351 91 (Draft 2) RESOLUTION AMENDING THE FUEL TAX INCREASE EXPENDITURE PLAN . WHEREAS, Resolution 397-88 , which was adopted by the Hawaii County Council on March 15, 1988, provided an additional 3 . 8 cents per gallon in fuel tax revenues for road resurfacing projects over a ten-year period ; and WHEREAS, Resolution 397-88 also provided that the $1 , 500,000 in additional annual revenues would be distributed and expended in accordance with a district distribution formula and a five-increment project plan as delineated in the attached Exhibit A of said resolution; and WHEREAS, Resolution 397-88 mandated that the apportionment formula be updated bi-annually; and WHEREAS, Committee on Public Works Report No. 142, which was adopted by the County Council at its May 1, 1991 meeting acknowledged the success of the fuel tax increase in providing for an improved highway resurfacing program, however, said report also recognized that further improvements could be realized with modifications ; and WHEREAS, the Committee on Public Works, at its July 9, 1991 meeting, further discussed the fuel tax increase program and acknowledged the following: The distribution formula does not necessarily reflect the use demands placed upon certain roadways, especially those primary roadways which are subject to more than localized traffic; The Department of Public Works, due to staff shortages , is experiencing difficulty in executing the program in an efficient and timely manner ; and WHEREAS, excess revenues are available for further appropriations due to revenues exceeding initial estimates . NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it hereby amends the fuel tax expenditure plan as follows: 1 . Proceeds from the fuel tax increase shall be expended in accordance with various appropriation ordinances. Said ordinances shall delineate appropriation as incremental or primary road projects . 1 (i i t� 4 2 . Exhibit A, as attached to Resolution 397-88, shall hereafter serve as an expenditure guideline in determining incremental projects for appropriations . 3 . Revenues in excess of the monthly amount projected for any increment shall be available for allotment to those circle island roadways as delineated in Schedule A as herein attached . 4 . When deemed necessary by the Chief Engineer appropriations may be applied toward the hiring of consultants for the prosecution of a particular project. 5 . The district distribution formula shall hereafter be updated biennially .
