Brown <br /> 77-6458 Leilani St. <br /> Kailua-Kona, HI 96740 <br /> Subject: A request for an amendment to the Animal Code, Chapter 4 to be considered at <br /> the next hearing by the County council. <br /> Please move the existing Hawaii County code, REFUSE, Chapter 20 ,ARTICLE 1, <br /> LITTERING ,Section 20-5 LITTER PROHIBITED ON OCCUPIED PRIVATE <br /> PROPERTY, to the Hawaii County code ,ANIMALS, CHAPTER 4. <br /> It would then be directly specific to some problems with neighbors who own multiple <br /> dogs who defecate in their yards and is not ever picked up, and how it affects the neighbors <br /> within 500 feet of the lot in a crowded city neighborhood. It is a health hazard and <br /> contaminates the soil. <br /> The reason for this request is a scenario at hand: <br /> SIX (6) medium to large dogs next door. <br /> Feces left in backyard for 6 months without being picked up. <br /> Neighbors have 20 feet between our lanais. <br /> The smell is overpowering and causes great distress. <br /> Neighbors feel sick inside their own bedroom and living room and outside on the <br /> deck or in their own yard.. <br /> I, am a concerned new citizen of Kona, have read and will quote parts of the present <br /> Hawaii County code. <br /> Chapter 20: Refuse <br /> Section 20-1 Definitions: <br /> Article 2. "LITTER" means any waste material including, but not limited to, any animal <br /> and vegetable wastes"............ <br /> Section 20-5 states: LITTER prohibited on occupied private property. <br /> "NO PERSON SHALL THROW OR DEPOSIT LITTER ON ANY OCCUPIED <br /> PRIVATE PROPERTY ,WHETHER OWNED BY THAT PERSON OR NOT........OR <br /> UPON ANY PRIVATE PROPERTY" <br /> SECTION 20-7 SUMMONS OR CITATION FOR VIOLATION <br /> A police officer shall use a form of summons or citation provided by the County in <br /> citing a violator of any provision of this article. <br /> SECTION 20-8 PENALTY <br /> Any person who violates the provisions of this article shall, upon conviction, be <br /> sentenced to pay a fine of not less than $250.00, and not more than $1,000 for each <br /> offense <br /> <br />
