COUNTY OF HAWAII STATE OF HAWAII <br /> BILL NO. 4 <br /> Draft S <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 4 OF THE HAWAII COUNTY CODE 1983 (1995 EDITION), <br /> ANIMALS. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION I. The purpose of this measure is to amend Chapter 4, Animals, by increasing the <br /> fines and permitting an animal care center to contract with the county to provide services for animal <br /> control and care. <br /> SECTION 2. Chapter 4, of the Hawaii County Code 1983 (1995 edition), is amended to read as <br /> follows <br /> "Chapter 4 <br /> ANIMALS <br /> Article 1. Defnitions. <br /> ~ ~5 <br /> Section 41. Definitions. ~ v°'~~ ,hN~rr <br /> <br /> As used in this chapter: /I;;-- ' ` <br /> <br /> (a) "Animals," unless provided otherwise, include~Uut are not limited to farm animals, ooultrv and those animals <br /> that are customary and usual pets such as dogs, cats, rabbits, birds, [heneybees] and other beasts which are <br /> maintained on the premises of a dwelling unit and kept by the resident of a dwelling unit solely for personal <br /> enjoyment and companionship, such as, without limitation, for a hobby, for legal sporting activities and for <br /> guarding of property; animals exclude aviary game birds and fish as defined in Hawaii Revised Statutes. <br /> [ <br /> 4.3~-] <br /> <br /> (bl "Animal care center" means a nonprofit organization that is exempt from taxation pursuant to section 501(cl <br /> of the Internal Revenue Code, 26 U.S.C., as amended formed for the purpose of prevention of cruelt~to <br /> animals. <br /> [(kj] ~ "At large" means on the premises of a person other than the owner of theCdo er small] <br /> domesticated animal or farm animal without the consent of the occupant of the premises, or on a {p~lie <br /> ] roadway, or in any public place except when under the control of a responsible person <br /> or an authorized representative of the owner. <br /> <br />
